DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, Rocky Mountain Acquisition Center, NCO 19; 4100 E. Mississippi Avenue, STE 900, Glendale, CO 80246 Justification for Other than Full and Open Competition, 2237 PR: 554-14-3-023-0661. 2.Nature and/or Description of the Action Being Processed: This is a sole source contract request for a firm fixed price contract with Rose Medical Center located at 4567 E 9th Ave., Denver, 80220 to provide emergency laboratory services for Denver VA Medical Center located at 1055 Clermont St, Denver, CO 80220. 3.Description of Supplies/Services Required to Meet the Agency's Needs: A capability need exists for a contractor to provide emergent care laboratory testing when the Denver Medical Center Pathology and Laboratory Medicine Services are unable to perform laboratory services due to a natural disaster, power outage, broken instruments or shortage of reagents. Denver VA Medical Center veterans require testing to be accomplished in an immediate accessible geographical location to Denver VA Medical Center. Base year with 4 option year total cost is: $37,568.40 Period of Performance base year: 1 July 2014 - 30 June 2015 Option years span from: 1 July 2015 through 30 June 2019 4.Statutory Authority Permitting Other than Full and Open Competition: The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c) (1), and FAR 6.302 (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Rose Medical Center is the only responsible source and no other contractor medical facility can satisfy this agency requirement. Rose Medical Center is located immediately adjacent to Denver VA Medical Center that offers Denver VA Medical Center to send patient laboratory samples to the contractor's facility within the shortest time possible. Emergent testing and reduced test results cycle time is critical to patient care on an emergency basis. This ensures expedient Veteran care and achieves the absolute shortest test processing cycle possible when Denver VAMC cannot meet critical demands. This provides Denver VA medical staff expedient results that directly affect Veteran lives and safety. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market research conducted revealed only one source available. See section 8 for further details. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost will be fair and reasonable IAW FAR 13.106-3(iv) based on pricing requested and received in comparison to the same or similar contract services provided within the region. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted through Government contract directory, VA National Contract directory, VETBIZ, Small Business Administration Dynamic search, GSA eLibrary, Federal Procurement Data System, known sources, and NCO19 Small Business Specialist. No vendors were found to provide this service within the immediate geographical location to Denver VAMC. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition None 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Denver VA Medical Center is building a new facility in Aurora. At the new location, VA ECHCS requirements for emergent laboratory services will be re-evaluated and other vendors will have an opportunity to compete for VA business. The contracting office will be notified of any new and upcoming requirements to assist in locating additional sources. The contracting officer will also conduct market research to identify potential sources that can satisfy requirements.
