Description
JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity: Department of Veterans Affairs Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for a firm-fixed-price delivery order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) IV Government Wide Acquisition Contract (GWAC) in support of the Department of Veterans Affairs (VA) Veterans Health Administration (VHA) Employee Education System (EES). This action is for the acquisition of three brand name Grass Valley high definition (HD) video servers and associated support for the studio uplink facility in St. Louis, Missouri and its remote production studio locations in Salt Lake City, Utah and Crystal City, Virginia. This procurement is to upgrade the existing Grass Valley standard definition video servers to HD and upgrade the existing Grass Valley Kayak video production switcher. This will ensure that the existing EES Grass Valley video workflow solutions are optimized. Additionally, it will ensure the upgraded Grass Valley video production equipment will integrate seamlessly into the existing Grass Valley video workflow environment. 3. Description of Supplies or Services: VHA EES is in the final phase of converting its studio uplink facility in St. Louis, Missouri and its remote production studios in Salt Lake City, Utah and Crystal City, Virginia to HD video. In order to support this migration, the current EES standard definition Grass Valley video servers must be upgraded to Grass Valley HD video servers. VA's EES is highly invested in Grass Valley's video server technology and the procurement of the new HD Grass Valley video servers and associated support will ensure compatibility with existing Grass Valley equipment and workflows. Procuring Grass Valley HD video servers will allow for seamless integration with existing Grass Valley products already being utilized by EES. Grass Valley HD video servers are intended to replace the Grass Valley standard definition video servers currently in use and integrated into the EES automation and video production environment. This requirement will also upgrade the existing Grass Valley Kayak video production switcher to expand the switcher's mix effect capability from two mix effects buses to three mix effects buses. The total estimated price of the proposed action is 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B), "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: Based on extensive market research, as described in paragraph 8 of this document, it is determined that limited competition is available among resellers for Grass Valley brand name items. Grass Valley video production equipment and Grass Valley video production switcher upgrade components are the only solutions to replace the existing Grass Valley video production servers and upgrade the Grass Valley video production switcher. The Grass Valley hardware and software is natively integrated in an existing Grass Valley environment and is tightly integrated and designed to work within the existing EES automation and video production workflow to include; video ingest and playout, video switcher time line, and digital effect manipulation. Also, Grass Valley video servers and software are designed to interface with the EES Media Asset Management (MAM) system to archive and recall video production assets. Grass Valley components are the only components that will effectively perform in a native Grass Valley environment and the only components that can be used to upgrade a Grass Valley video production switcher. Any attempts to upgrade the Grass Valley equipment using another manufacturer's components would render the existing Grass Valley equipment non-functioning and would render the existing EES production environment inoperable; severely impacting the number of training videos EES produces for VA staff. The only alternative solution in lieu of upgrading the existing Grass Valley equipment would be to replace all existing Grass Valley components with another equipment manufacturer brand at an appreciably higher cost. Based on the above, the procurement of a brand name product other than Grass Valley cannot meet the Government's technical requirements. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. In accordance with FAR 5.301 and 16.505(b)(2) the contract award will be synopsized on the Federal Business Opportunities (FedBizOps) Page. In addition, this Justification for an Exception to Fair Opportunity will be made publicly available on the FedBizOps Page subsequent to contract award and posted on the NASA SEWP IV website with the solicitation. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government will continue to perform market research to determine if there are any products available that will enable future requirements to be competed. 8. Market Research: The Government's technical experts conducted market research from November 18, 2013 to December 4, 2013 by searching the General Services Administration (GSA) and NASA SEWP IV Websites, internet and other broadcast equipment reseller resources for similar products such as Electronic Video Systems (EVS) XT, Harmonic's Spectrum and Avid's Air Speed video servers. The Government determined the cost to abandon its existing Grass Valley technology and integrate another manufacturer's video server products into an existing Grass Valley production environment would not be cost effective and limit current performance capabilities. Performance capabilities would be limited in that the existing video production environment is based on Grass Valley production technology and natively communicates with other Grass Valley production equipment. Furthermore, the Grass Valley mix effect upgrade for the Grass Valley Kayak video production switcher can only be performed by using specific Grass Valley Kayak circuit cards specifically designed for use in the Grass Valley Kayak production switcher as it is the only solution interoperable with the existing components. 9.
