- NOTICE OF INTENT TO AWARD SOLE SOURCE The U.S. Army Contracting Command - Aberdeen Proving Ground (ACC-APG), MD 21005 intends to award a firm-fixed price (FFP) contract, with a base period of eight (8) months and one twelve (12) month option, under FAR part 8.405-6(a)(B), quote mark Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. quote mark The Government intends to issue an award on a sole source basis to Knowledge Sharing Systems (KSS), Inc., under GSA contract number GS35F01895. KSS owns the data rights to this customization of a commercial, off-the-shelf software program, and it is at present the only software fully certified with the Department of Defense Information Assurance Certification and Accreditation Process (DIACAP). KSS is the only source that can complete these services within eight (8) months after award, as required, because their Knowledge Information and Technology Sharing System Software (KITS) is already DIACAP approved with a current Authorization to Operate (ATO). KITS is a tool that significantly increases the effectiveness of the Research, Development and Engineering Command's (RDECOM) Technology Transfer (T2) functions. The services required are unique and are only available from KSS, the developer of this application, and they do not offer quote mark right-to-copy quote mark licenses. Market research conducted did not yield an appropriate alternative or compatible source that could meet this unique requirement and provide the same functionality as KITS in a timely manner. This notice of intent is not a request for proposals or quotations. No Statement of Work will be provided. Requests for copies of a solicitation in response to this notice will not be honored or acknowledged. A determination by the Government not to compete this proposed action upon receipt of responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether conducting a competitive procurement is in the best interest of the Government. Interested parties shall identify their interest and capability to respond to this requirement, no later than 11:00 AM EST, 17 Dec 2013. All information submitted shall be furnished at no cost or obligation to the Government. Responses must be in writing and must provide clear and concise documentation indicating an offeror's bona fide capability to provide the items and services. Verbal responses are not acceptable and will not be considered. Responses may be submitted via email if the total file size is less than 5MB. Otherwise, responses must be submitted via hard copy to: U.S. Army Contracting Command, Aberdeen Proving Ground (ACC-APG), 4310 Boothby Hill Rd., APG, MD 21005.
