JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION < SAT FOR BRAND NAME JUSTIFICATION NITYU4RV004 RightFax Maintenance Renewal REFERENCES: • FAR 13.106 (b) states that, "For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization). The following documentation constitutes the rationale for this decision DOCUMENTATION: (1) Requiring Activity: a. The required OpenText RightFax Maintenance is available from multiple resellers and the estimated cost of this acquisition is $59,242.11. Also, DISA will not issue an authority to connect (ATC) - turning on DSN telephony services - until sufficient documentation has been submitted showing the configuration and use of an approved JITC solution. The only facsimile solution approved at this time is OpenText RightFax. OpenText RightFax products, support, and maintenance are available from authorized resellers of OpenText RightFax. DFAS is renewing licenses and purchasing maintenance for the OpenText RightFax software currently loaded on DFAS systems. RightFax is installed on all user workstations at DFAS and a new system would require a new client, training of DFAS users on the new client, management of achived faxes, phonebooks and contacts previously created. The renewal of OpenText RightFax maintenance and support represents the only approach for the Government, ensuring continuity of operations and reducing the costs/user impact by enabling the use of the DSN network. DFAS has over $300,000.000 invested in OpenText RightFax software through past acquisitions. The cost to procure another application would be in excess of $450,000.00, in addition to the training and installation costs that are associated with any new application. Consequently, the renewal of the OpenText RightFax maintenance represents the most cost effective approach for DFAS, ensuring continuity of operations without interruption. (4) Market survey (indicate if any other firms were contacted or expressed interest) Market research was conducted for the purpose of seeking as many potential sources as possible. Although OpenText RightFax is the sole manufacturer and provider of the service, there are multiple distributors who have expressed interest based on market research: Dynamic Solutions Group, Syscom Services, Advantage Technologies and AGSI Systems with the required maintenance and support available on the open market. An RFQ will be posted on FedBizOpps. Competition will be sought among all authorized resellers for the best possible pricing. (5) Technical requirements personnel certification I hereby certify that this justification is made in good faith, that the supporting data and information are accurate and complete to the best of my knowledge and belief, and that I would not be making this request if it were feasible to fully compete this requirement. I further certify that this request is not the result of lack of advanced planning or a desire to expend funds while those funds are still available. Signature DATE David Banton Technical Review (6) Price Reasonableness Determination: In determining a fair and reasonable price, the Contracting Officer will evaluate a more detailed breakdown from a formal Independent Government Cost Estimate (IGCE). The detailed estimate will provide the level of effort of individual items identified above and potential hardware/software categories, as well as estimated costs. The estimated costs of the hardware/software will be compared to established pricing on other Government contracts, such as the General Services Administration's (GSA) Federal Supply Schedule (FSS) for the same hardware/software categories and/or similar items. Additionally, price comparisons will also be accomplished from as many other sources as possible, including commercially as well as any Government-Wide Acquisition Contracts (GWAC). These products/services are available from one or multiple authorized resellers. Based on market research, it is anticipated that open market pricing will be fair and reasonable. Leveraging DFAS' current use of the Vendor/Manufacturers product and services, along with open market price comparison, the contracting officer is confident in obtaining the best value for DFAS. (7) Contracting Officer's certification I hereby certify that this justification is made in good faith, that the supporting data and information are accurate and complete to the best of my knowledge and belief.
