- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Army Contracting Command-Warren (ACC-WRN) proposes to negotiate and award, on an other than full and open competition basis in accordance with FAR 13.106-1(b)(1), Soliciting from a Single Source, a contract with The MathWorks Inc., 3 Apple Hill Drive, Natick, MA 01760-2098 (CAGE Code: 0C524). This acquisition is for a software license maintenance subscription for Matrix Laboratory (MATLAB) software, for Center for Army Analysis (CAA). This agreement is for a 12 month base period, beginning the day of contract award, with two option periods for a total contract duration of three years. This announcement constitutes the only solicitation. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-66. The associated North American Industrial Classification System (NAICS) code for this procurement is 511210 with a small business size standard of $35.5M. This requirement is a not a Small Business set-aside. All responsible sources may submit a capability statement or quotation, which shall be considered by the agency. The selected Offeror must comply with the following commercial item terms and conditions, which are incorporated herein by reference: FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items - the selected offeror must submit a completed copy of the listed representations and certifications; FAR 52.212-4, Contract Terms and Conditions - Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items and the following clauses in paragraph (b): 52.219-28, 52.222-3, 52.222-19, 52.223-18, 52.225-13, and 52.232-33. The full text of the referenced FAR clauses may be accessed electronically at https://www.acquisition.gov/far/. Offerors must be registered and have completed its representations and certifications on www.sam.gov (System Acquisition Management).
