Description
NOTICE OF INTENT: The U.S. Environmental Protection Agency (EPA) intends to purchase 34 compressed gas cylinders and have them filled from Scott-Marrin, Inc.; 6531 Box Springs Blvd; Riverside, CA 92507. This is a NOTICE OF INTENT ONLY for purposes of (1) negotiating a sole source procurement under authority of FAR 13.106-1(b)(1) with Scott-Marrin, Inc. and is not a Request for Proposal. This notice is not to be construed as a commitment on the part of the Government to award a contract, nor does the Government intend to pay for any information submitted as a result of this notice. The Government will not reimburse respondents for any costs associated with submission of the information being requested or reimburse expenses incurred by interested parties for responses to this Notice. However, the Government will consider responses received by August 20, 2013. No solicitation is available. EPA?s National Performance Audit Program (NPAP) manages a network of audit systems operated by the EPA Regions. These systems provide independent ambient air monitoring for the EPA National Ambient Air Quality Standard (NAAQS) and gas analyzer audits at State and Local Air Monitoring Stations (SLAMS) sites within each Region. NPAP has a requirement for consistency and comparability in auditing of NAAQS gas analyzers in all 50 states in the Environmental Protection Agency?s ten (10) regions. The audit measurements are all based on the gas standards the EPA?s NPAP uses. To minimize inconsistencies, it is important to minimize the sources of variability in measurements. Using the same source of the audit gas standards is one of the most important sources of variability that can be controlled. The NPAP also uses very detailed standard operating procedures (SOPs) and software designed by EPA to calculate the audit results. Consistency is especially true for the more challen ging trace level audits, and particularly for the audits of the new CO and NOy trace level analyzers, the current and proposed bases of NPAP?s CO, SO2 and NOy audits. The sole source determination is based on NPAP?s continued need (1) to obtain compressed gas cylinders from the same source to minimize variability between audits across the country and (2) for consistency and uniformity with the Scott-Marrin, Inc. compressed gas cylinders currently in use within the National Performance Audit Program. Changing this constant could result in (1) questionable audit results which can have significant economic consequences, (2) the ability of the audit systems to perform as designed, and (3) be as comparable to each other as possible. Scott-Marrin, Inc. has been identified as the only vendor capable of satisfying the Agency?s requirement in order to ensure that the audit values are traceable by intermediate comparisons to the National Institute of Standards and Technology (NIST), to inter-compare all the gas measurements from each ambient air monitoring agency, and to evaluate their degree of inter-comparability to equivalent NIST measurements. The circumstance permitting ?Other than full and open competition: is the Federal Acquisition Regulation (FAR) 13.106-1(b)(1) ? Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold. The North American Industry Classification System (NAICS) code for this effort is 424690, Other Chemical and Allied Products Merchant Wholesalers with a size standard of 100 people. No solicitation package will be issued. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Therefore, no solicitation (RFP) is currently available. Interested businesses should submit a capability statement which demonstrates their firm's ability to successfully perform the overall requirements as noted above. Responses must also include the following: name and address of firm, size of business, DUNS, number of years in business, ownership, parent company/affiliate information, joint venture partners, and a list of customers during the past three years to include the contract numbers/contract type/dollar value of each procurement and point of contact's name/address/phone number. This capability statement shall not exceed five (5) pages in length and shall be sent electronically to Tillie Newsome, at newsome.otelia@epa.gov within 7 days of the date of this announcement. Additionally, interested parties must (1) be registered in the System form Award Management (SAM) and (2) have completed the Representations and Certifications to be eligible for consideration. Any response(s) failing to provide a capability statement but instead choosing to merely submit a routine letter requesting a copy of the RFP will not be honored. Interested vendors shall: 1) include information and specifications on the proposed supplies which clearly supports the requirements outlined above; 2) fully explain your capabilities and qualifications and; 3) provide itemized pricing that is sufficient to make a determination that competition is feasible. Response to this synopsis must be made in writing. No telephonic or faxed request will be honored.
