- Request for quotation 2013-61304 This is a solicitation for commercial services prepared in accordance with the format in Federal Acquisition Requirements (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested, and a written solicitation will not be issued. The solicitation number for this requirement is 2013-61304 and is hereby issued as a Request for Quote (RFQ) using FAR Subpart 13.1 Simplified Acquisition Procedures. The Centers for Disease Control and Prevention intends to award a firm-fixed-price contract for the following requirement, please either fill in the dollar amounts or provide a separate excel spreadsheet containing the same information: CLIN 0001: Total Price $ Services for policy and standard development for internation standards. Statement of Work ATTACHMENT 1 STATEMENT OF WORK Statement of Work PR: 000HCCLH-2013-61304 STUDY TO DETERMINE THE FEASIBILTY OF USING INTERNATIONAL STANDARD ORGANIZATION (ISO) VOLUNTARY CONSENSUS STANDARDS FOR CERTIFICATION OF RESPIRATORY PROTECTIVE DEVICES (RPD) INTRODUCTION The National Personal Protective Technology Laboratory (NPPTL), a division of the National Institute for Occupational Safety and Health (NIOSH) has actively participated in ISO standards development for RPD since ISO formed the Technical Committee (TC94/SC15: Personal Safety- Protective Clothing and Equipment-Respiratory Protective Devices) in 2002. NIOSH administrative and technical leadership recognize the importance of active participation in national and international standards development activities to the current and future regulatory obligations of the agency. NIOSH further recognizes the need for global harmonization of standards and the potential economic advantages provided by international standards to the producers and users of respirators. NIOSH requests that the contractor provide an economic analysis to compare the costs related to current NIOSH approval requirements in 42 CFR Part 84 and the newly developed ISO test method and product performance standards. The study would establish the costs and possibly benefits associated with acquiring infrastructure capabilities to certify all categories of air-purifying respirators (APRs) to ISO standards, using ISO adopted test methods. While the ISO test methods are often similar to current NIOSH test methods, the equipment required or the accuracy required by the method/procedure may be different. The contractor will provide a detailed cost analysis and report of costs associated with the implementation of ISO standards for certification of all class of APRs by the Institute. The contractor will provide a detailed outline/proposal for a more comprehensive economic impact/benefit analysis to include, based on all current ISO standards (drafted to date) the potential impacts on the industry including the Institute, the Occupational Safety and Health Administration (OSHA), other standard development organizations, regulatory agencies, manufacturers, employers/users, and others providing training, guidance and exposure assessments. I. TASKS (1) Economic analysis of potential NIOSH ISO approval of APRs The contractor shall prepare an assessment which addresses the potential costs to NIOSH to complete approvals of industrial APRs (non CBRN - chemical, biological, radiological and nuclear) according to newly developed ISO respiratory performance standards. The study will also identify the potential benefits of using ISO test methods and performance standards to the agency and the stakeholders. The analysis shall include the costs of acquiring the infrastructure capabilities needed to certify all industrial categories of APRs. The cost analysis of infrastructure shall include costs such as facilities (space required, renovations, or new requirements), instrumentation and detection systems, staffing requirements and staff training, laboratory supplies, computer hardware and software needs (updating or maintaining databases). The analysis shall include other costs associated with the implementation of new international consensus standards, including but not limited to correlation studies, requirements for notified testing and certification bodies, data collection and maintenance, and potential costs associated with anticipated revision cycles. The contactor will be required to purchase relevant published ISO standards and technical specifications. NIOSH will provide confidential drafts of other unpublished standard and technical specifications that are relevant to the cost analysis. Given that some relevant standards are not fully developed and published, the contractor must clearly define any assumptions or rationales used in completion of this analysis and document the draft standard or technical specification referenced for a given assumption or rationale. The current rule, 42 CFR Part 84- Approval of Respiratory Protective Devices and all relevant NIOSH Standard Test Procedures (STPs) are accessible electronically: http://www.ecfr.gov/cgi-bin/text-idx?tpl=/ecfrbrowse/Title42/42cfr84_main_02.tpl http://www.cdc.gov/niosh/npptl/stps/respirator_testing.html The list of manufacturers or suppliers that produce NIOSH certified respirators may be obtained from the NIOSH Certified Equipment List (CEL): http://www.cdc.gov/niosh/npptl/topics/respirators/CEL/default.html (2) Development of detailed outline/plan for a comprehensive economic impact/benefit analysis of a national strategy for full implementation of ISO Respiratory Protection Standards The contractor shall prepare an a detailed outline and plan which addresses the Regulatory Assessment Requirements including the estimates for costs, measures of benefits and economic impacts of a potential implementation of ISO Respiratory Protection standards and test methods for all classes of respirators currently approved by NIOSH according to 42 CFR 84. Based on all ISO standards (as drafted to date of the study), the contractor shall consider all areas/topics that could contribute to a comprehensive economic impact/benefits analysis to be completed at a future date. This would likely consist of the following: testing capabilities for all categories of RPD (use completion of Task (1) as a model), updating of national training materials, selection, use and maintenance guides and materials, related voluntary and regulatory standards, etc. The contractor shall "virtually" meet with the NIOSH/NPPTL ISO Working Group to determine best methods for generating input from stakeholders to define all potential costs and benefits categories to be included in a comprehensive implementation cost/benefit analysis. The outline and plan will clearly identify the relevant categories that must be considered in future studies to fully assess the costs and benefits of implementing ISO standards by NIOSH, OSHA and MSHA. The plan shall also consider FDA, NFPA and other regulatory and voluntary standard organizations that could be impacted by this change. The final outline and plan shall be designed to facilitate an assessment meeting the requirements of Executive Orders 12866 and 13563, the Regulatory Flexibility Act, the Small Business Regulatory Enforcement Act, and the Unfunded Mandatory Reform Act of 1995. II. DATA MANAGEMENT All data sources used for the reports will be documented in the bibliography and made available to NIOSH. All computer worksheets and databases created for this contract will be submitted to NIOSH. The contractor shall use Microsoft Excel to develop all spreadsheets and tables. The contents of every spreadsheet will be described in the upper left corner. Key variables and constants will be clearly shown. The spreadsheets and accompanying documentation must be adequate to ensure that others can understand and reproduce the quantitative results derived from the spreadsheets. Text of the reports will be drafted in Microsoft Word. III. SCHEDULE FOR CONTRACT DELIVERABLES The deliverables specified in this Statement of Work shall be submitted under the following schedule. (1) Project Plan: Two weeks from the date of execution of this contract, the contractor's team leader for this project and one other representative of the contractor, directly responsible for the data collection and analysis, shall discuss (via internet or telephone) the plan to complete the task order with the COR and the NIOSH Program Manager. The contractor will then electronically submit a written plan for review by the COR and the NIOSH Program Manager within 14 days following the internet or telephone discussion. (2) Milestone Progress Reports: The contractor shall prepare electronic monthly milestone progress reports that will be submitted to the COR. The reports shall highlight significant progress as outlined in the TASK I. These reports shall consist of (i) work performed, (ii) dollars spent, (iii) problems encountered and proposed solutions, (iv) an outline of plans for the next reporting period. The milestone progress reports shall be submitted on or before the tenth working day of each month in electronic form to the COR. The technical leader for the contractor will participate in monthly teleconferences when requested by the COR and the NIOSH Program Manager to review the milestone progress reports. (3) Final Reports: Contractor will submit a draft final report 6 months following the initial project planning discussion. The final report shall include all finding of the Task (1) cost analysis and the detailed outline/plan required in Task (2). After review and approval of the draft final reports by NIOSH staff, final reports on the information collection initiatives will be submitted by eight months after the beginning of the contract. Within 14 days of the issue of the final report, the technical lead(s) for the project will participate in a virtual meeting with the NIOSH/NPPTL ISO Working Group to discuss the major findings of the report and the use of any mathematical models or computer programs/spreadsheets developed to complete the analysis. IV. MINIMUM REQUIREMENTS for VENDOR The development and promulgation of standards and rules relating to occupational safety and health requires great technical breadth. Therefore, NIOSH/NPPTL requires the following minimum requirements concerning the technical and professional qualifications and experience of the contractor and the employees of the contractor supporting this contract: Contractor Lead: 15+ years relevant experience in managing economic and health risk/benefit regulatory analysis and rulemaking support activities for rules involving occupational safety and health; preferably with documented support of successful promulgation of a rule by OSHA, FDA, or MSHA with occupational safety or health impacts. Certified Industrial Hygienist: 10+years relevant experience in regulatory analysis and rulemaking activities for rules directly involving occupational safety and health impacts; including OSHA's Respiratory Protection Standard and Assigned Protection Factors. Economist/Statistician: 10+years relevant experience in regulatory analysis and rulemaking activities for rules directly involving occupational safety and health; including OSHA's Respiratory Protection Standard and Assigned Protection Factors. Engineer or scientist: 5-10 years relevant experience with evaluation/test methods for product performance, including methods for evaluation of respiratory protective devices. V. GOVERNMENT PROVIDED MATERIALS The government will provide background information as needed, including electronic copies of the most current drafts of all relevant ISO standards and technical specifications. VI. PERFORMANCE MEASUREMENTS Contractors must provide a quote that reflects the specific requirements stated in this solicitation. It must demonstrate the ability to perform the needs of the government. Award will be made based on the technically acceptable with lowest cost to the government. "Offerors are advised that funding for this project has been provided on a limited basis, and cost must not exceed $100,000.00 for a total contract amount. Proposals exceeding $100,000 will not be evaluated or considered for award." VII. PERIOD OF PERFORMANCE The period of performance is 30 days from date of award through September 30, 2014. VIII. CONFIDENTIALITY 1. The contractor agrees not to publish or otherwise release reports or any analysis conducted or data collected during the performance of this task order without the express written permission of the NIOSH Program Manager. 2. Information provided by NIOSH for this contract is confidential and the contractor shall not use this information for purposes other than this task order without the express written permission of the COR or NIOSH Program Manager. 3. All data, worksheets, computer programs, and other working papers used in the development of deliverables under this task order shall be made available to the COR or NIOSH Program Manager, upon request.
