- Statement of Work JOFOC The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with ASML US, Inc. of Tempe, AZ for the purchase of an extended warranty per the attached Statement of Work, under other than full and open competition by the authority of FAR subpart 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements per 41 USC 253(c) (1). The Sole Source determination is based on NIST, Boulder Micro fabrication Facility (BMF) purchasing the wafer stepper from ASML US, Inc. for patterning micro electric circuits. Delivery is FOB Destination, Boulder, CO. The NAICS code for the proposed acquisition is 811219, with a Small Business size standard of $19M. No solicitation package will be issued. This notice of intent is not a request for competitive quotations. The Government will consider responses received by 12:00 noon (MST) on February 11, 2013. Inquiries will only be accepted via email to patricia.bullington@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
