- Description
- The Government intends to award a sole source Firm Fixed Price contract to Thales-Raytheon Systems Company, LLC (cage code: 1TDN2) for corrective and preventative support for the BCS-F system at two locations. The support provides help desk support, on-site service calls, system configuration maintenance, and provide approved Anti-virus software updates. The BCS-F system is based upon non-commercial 'Command and Control' software developed by Thales-Raytheon Systems, LLC, at their private expense. Thales-Raytheon Systems asserts 'restricted' rights over Command and Control software products related to the system. These 'restricted' software products include Sentry Software (consisting of Operations Computer Software, System Control Services, Sim Scenario Generator, Data Reduction Software, Communication Infrastructure Services (CIS)), Procon Software and the BCS Test Harness. These 'restricted' rights are asserted under DFARS clause 252.227-7014, 'Rights in Non Commercial Computer Software and noncommercial computer software documentation.' In accordance with FAR 6.302-1(b)(2), only one source is capable of providing these services because of the existence of these 'restricted' rights in noncommercial software products developed at private expense. A determination not to compete this requirement is based on market research and is solely within the discretion of the Government. The North American Industry Classification System (NAICS) code is 541519, business size standard is $25 million. This notice IS NOT a request for competitive quotations. However, the Government will consider all offers received not later than 19 June 2013 3:00 PM Eastern Standard Time. The Government will not be responsible for any cost incurred in offer preparation. A determination by the Government not to compete the proposed procurement action based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. No solicitation is available and telephone request for information will not be taken.
