- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of the Agency and the Contracting Activity: Department of Veterans Affairs, Atlanta Regional Office 2. Nature and/or description of the action being approved: Justification and approval for other than full and open competition for the acquisition of a construction contract for residential modifications for an Independent Living Veteran. 3. A description of supplies/services required: Independent Living Home Modification to existing home of veteran's home located in the state of Georgia. The home modification includes removing existing asbestos shingles and replacing them with new vinyl siding. Approximate 166 SF addition will be added and a rear deck with a walking ramp. 4. Statutory authority permitting other than full and open competition: 38 U.S.C 8127, Public Law 109-461 and FAR 6.302-5, Authorized or Required by Statute 5. Facilities Unique Qualifications: None 6. Efforts made to ensure that offers are solicited from as many potential sources as is practicable: The Notice of Award will be posted in FEDBIZOPS upon contract award. The exception granted at FAR 5.202(a)(4). The next opportunity for award will be considered on a case-by-case basis for award. 7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: The anticipated award price of the contract under $48,715.00 will not exceed the simplified acquisition threshold (as defined in section 4 of the Office of federal Procurement Policy Act (41 U.S.C. 403) and will not exceed $5,000,000; in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price that offers the best value to the United States. 8. Market survey conducted: Sources Sought Notice - The concern, HTL Construction, LLC. is a Service Disabled Veteran Owned Small Business registered in the Vendor Information Pages (VIP) database. A review of HTL Construction Inc capability/profile information revealed that they have the experience, expertise to perform the scope of work outlined in this project. HTL Construction, LLC is determined to be a responsible source with respect to performance of such contract opportunity. 9.Other facts: None 10.Other sources expressing an interest: Not Applicable at this time 11.Actions to remove or overcome any barriers to competition: This acquisition will not be synopsized in the Federal Business Opportunity System pursuant to the exception granted at FAR 5.202(a)(4). The next opportunity for award will be considered on a case-by-case basis for award. 12.Certification: I certify that this justification is accurate and complete to the best of my knowledge.
