- Intent to Sole Source The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b) (1), with Oce for copier service agreements. Currently NIST's Management Resources Department has three Oce copiers that need a Full Service Agreement (FSMA) The three copier model numbers are 3165 3165SLEC and 4941099. SERVICES / DUTIES The Contractor shall provide all necessary implements to maintain the equipment in working condition in accordance with Original Equipment Manufacturer's (OEM) specifications. The Contractor shall perform unscheduled, on-call remedial maintenance as needed. Such maintenance will include lubrication, adjustments, and replacement of maintenance parts deemed necessary by the Contractor in accordance with OEM. Contractor shall provide all parts, travel, labor, preventative maintenance and supplies (toner and staples). Paper is not included. Contractor shall respond to repair calls within 6 hours and repair non-functioning equipment within 24 hours. Contract shall perform scheduled preventive maintenance based upon the specific needs of the individual machines as determined by OEM. Preventive maintenance shall be performed on a schedule which is mutually acceptable to the Government and the Contractor, which is consistent with the Government's operating requirements, and which is based upon the specific needs of the equipment as determine by the OEM. Such schedules shall be in writing and shall specify the frequency and duration of preventive maintenance for the equipment in the contract. DELIVERIES AND PERFORMANCE Upon receipt of required repair calls from the CONTRACTING OFFICER OR HIS CONTRACTING OFFICER'S REPRESENTATIVE (COR), the Contractor shall accomplish all repairs within 8 business hours after receipt. If repairs cannot be accomplished within 8 business hours, the Contractor shall furnish the COR written documentation within 8 business hours showing the cause for delay of repairs. Thereafter, the Contractor shall continue to furnish the COR written documentation on a weekly basis explaining reason for delay until the repairs have been completed. If the cause for delay is determined by the COR to be unacceptable, the COR will furnish the CONTRACT ADMINISTRATOR written documentation explaining how services were determined to be unacceptable (See Section titled "UNACCEPTABLE PERFORMANCE"). If the CONTRACTING OFFICER concurs with the COR's determination, an amount for unacceptable performance may be DEDUCTED from the Contractor's invoice as follows: (Computation Method: Item rate minus 25% may be deducted for each item that has unacceptable performance.) Unacceptable performance may also result in termination in accordance with the GSA schedule/basic contract. If the Contractor does not agree with the determination, refer to the "Disputes" clause. ON-CALL MAINTENANCE SERVICE The Contractor shall provide on-call maintenance service and repairs on all items listed in the contract. The Contractor shall furnish all repair parts, labor, and transportation required to accomplish item repairs. Contractor shall maintain all equipment in this contract at levels necessary to provide the specified functions to meet the manufacturer's current equipment specifications. PREVENTATIVE MAINTENANCE SERVICE The Contractor shall provide preventive maintenance service on Government-owned equipment listed in the contract. The Contractor shall furnish all repair parts, labor, supplies and transportation required to accomplish inspecting, cleaning, lubricating, adjusting, calibrating, vacuuming (if required), and repairing of items. Contractor shall maintain all equipment in the contract at levels necessary to provide the specified functions to meet the manufacturer's current equipment specifications. HOURS OF OPERATION All services defined in the contract shall be accomplished during regular work hours (8:30 a.m. to 5:30 p.m., Monday through Friday) except for federal holidays observed by this agency or by mutual agreement between the Contracting Officer and the Contractor. The North American Industry Classification System (NAICS) code for this acquisition 423440, with a size standard of 100 employees. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No solicitation package will be issued. This notice of intent is not a request for competitive quotations. However, responses received by December 5, 2012 will be considered by the Government.
