Description
NOTICE OF INTENT TO UNDERTAKE A SOLE SOURCE CONTRACT ACTION TO ADD ADDITIONAL SERVICE COVERAGE TO AN EXISTING CONTRACT Network Contracting Office 8 intends to undertake a sole source contract action for the procurement of periodic maintenance and repair services for its EVOTECH sterilization equipment at its West Palm Beach VA Medical Center. The following system requires coverage. DescriptionQuantity EVOTECH Endoscope Cleaner & Reprocessor 208V 5 These services will be procured from Advanced Sterilization Products (ASP), a Division of Ethicon, Inc., a Johnson & Johnson company, located at 33 Technology Drive, Irvine, CA, 92618-2346. The applicable NAICS code for this procurement is 81129 (Other Electronic and Precision Equipment Repair and Maintenance), with a size standard of $19 million. The Government intends to issue a modification to contract VA248-12-C-0202 for this requirement on a Sole Source Basis, per FAR 6.302-1(a)(2), wherein "the supplies or services required by the agency are available from only one responsible source." Servicing the systems requires both adequate training and the ability to provide replacement parts. ASP will not sell parts for the EVOTECH systems to anyone who has not undertaken their official training course in Irvine, CA. Moreover, their technicians are legally bound by a non-compete agreement which prohibits them from servicing the EVOTECH systems independently of ASP. Because of these two factors, besides ASP, there are no known providers of EVOTECH system maintenance service. All responsible sources which assert that they can provide these services may submit a capability statement which shall be considered by the agency. Interested respondents must submit a capability statement within 3 business days after the publication of this notice. Submission of a capability statement shall be made via email, to Eric Sullivan, Contracting Officer, at eric.sullivan2@va.gov. Subject of email should reference VA248-12-C-0202. All responses received will be evaluated. A determination by the Government not to compete the proposed procurement, based upon the responses to this notice, is solely within the discretion of the Government. Costs associated with the preparation and submission of information and any follow-up information requests are the responsibility of the offeror, and these costs will not be reimbursed by the Government.
