- Introduction: Pursuant to FAR Subpart 13.106-1(b)(1), the Army Contracting Command - Aberdeen Proving Ground, CCAP-SCN, Natick Contracting Division, on behalf of the Natick Soldier System Center (NSSC), intends to award a firm fixed price purchase order on a sole source basis to: Clamshell Structures Inc. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE QUOTES and no solicitation will be issued; however, any firm that believes it can meet the requirement may give written notification to the Contracting Officer. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the requirement listed. A determination by the government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. 1. Nature and description of the supplies or services required to meet the agency's needs: The Shelters Technology, Engineering & Fabrication Directorate is in need of spare parts for Clamshell Large Area Maintenance Shelter - V. The spare parts needed are a tan exterior beam cover, door assembly with fan, panel C/S ground seal (tan/white black-out), base plates, 400W light assembly HPS and electrical harness system. 2. A demonstration that the proposed contractor is the only source available to provide these services or goods (i.e. unique qualifications, proprietary rights, etc.): Clamshell Structures Inc. is original manufacturer of the building to be repaired and only Clamshell parts are compatible with Clamshell shelters. These shelter repair parts are unique and proprietary to Clamshell Structures and they are not universally configured as there is no industry standard. 3. A description of the market research that was conducted and the results, or a statement of the reason a market research was not conducted: Engineering plus design experience, coupled with extensive field surveys provides sufficient knowledge that these requested parts are proprietary and there is no one industry standard product to match. 4. Any other facts supporting the use of other than full and open competition: The design of these shelters results in parts which are proprietary. In order to develop other vendors would have to remove the parts from the existing shelter to see if they could reverse engineer the parts. 5. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: This is a follow-on action to a previously competitive action. Open competition resulted in the selected vendor providing a shelter that now needs repair parts. Clamshell is the only vendor able to supply the parts because they are the sole manufacturer of the clamshell parts. 6.
