- This contract action was accomplished using other than competitive procedures because the procurement is awarded to a sole source under the Test Program for Certain Commercial Items (FAR 13.5). See posted J&A for further information. PRIORITY 3 ACQUISITION MEMORANDUM FOR RECORD FOR OTHER THAN FULL AND OPEN COMPETITION BELOW THE SIMPLIFIED ACQUISITION THRESHOLD 1. Contracting Agency: Southern Regional Contracting Office, Brooke Army Medical Center (BAMC), Fort Sam Houston, TX 78234 2. Description of Action: Urgent procurement of AmnioSurgix Human Allograft, AmnioExcel and Amniologix-Dryflex for a patient in the Plastic Surgery Division 3. Description of Products/Services: The product is a crypto preserved liquid allograft derived from amniotic membrane; provides a structural matrix for use in filling soft tissue defects and bone voids. It is also acts as a localized wound covering. 4. Authority Cited: -Pursuant to FAR Part 13.106-1(b)(1), Soliciting competition. For purchases not exceeding the simplified acquisition threshold, contracting officer may solicit from one source if the contracint officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency). -Pursuant to FAR Part 5.202(a)(2), Exceptions. The unusual and compelling requirement will not be advertised. -Pursuant to FAR Part 13.106(c)(1), Soliciting competition. Price and availability will be obtained telephonically. 5. Reason for Cited Authority: The above statutory authority is cited because this is a true, urgent request that has been verified by _Janet Rindorf_ on _03 July 2012_. The AmnioSurgix Human Allograft, Amniologix-Dryflex and Amnioexcel is needed for a patient scheduled for an urgent procedure on _06 July 2012. Without this immediate treatment patient will need to undergo an extensive surgical operation which could be detrimental to the patient's life as well as the hospital's overall medical mission. 6.
