- Justification for Other than Full and Open Competition This is a combined synopsis/solicitation for the Sole Source of a commercial item prepared in accordance with the format in FAR 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. a. Solicitation number HQ003021110002 is being issued as a Request for Quotation (RFQ) b. Provisions and clauses are those in effect through both Federal Acquisition Circular (FAC) 2005-58 effective 18 Apr 2012 and DFARS Change Notice 20120420. c. The North American Industrial Classification System (NAICS) code for this procurement is 512120, "Motion Picture & Video Distribution", with a small business standard of $29.5 million. d. DESCRIPTION: CLIN 0001 (Base Period): TELEVISION PROGRAMMING - FFP CLIN 0001AA - Universal City Studios Productions shall provide the administrative effort required to authorize broadcast rights to its television programming aired on Bravo, Oxygen, SyFy, and USA Network for the American Forces Network - Broadcast Center (AFN-BC) to reproduce and distribute, provide live feeds or recorded copies of authorized programs and provide access to websites. AFN-BC will distribute the programming by encrypted, digitally compressed satellite transmission system (currently Cisco's PowerVu Plus (MPEG-4)) and/or by mail to authorized AFN-BC television outlets outside the contiguous United States for their non-commercial distribution/presentation via television broadcast frequencies, encrypted, digitally compressed satellite transmission, and/or limited closed-circuit distribution systems. License Period: June 1, 2012 through September 30, 2012. CLIN 0001AB - Universal City Studios Productions shall provide the administrative effort required to authorize broadcast rights to its television programming aired on Bravo, E! Entertainment, G4, Oxygen, Style, SyFy, and USA Network for the American Forces Network - Broadcast Center (AFN-BC) to reproduce and distribute, provide live feeds or recorded copies of authorized programs and provide access to websites. AFN-BC will distribute the programming by encrypted, digitally compressed satellite transmission system (currently Cisco's PowerVu Plus (MPEG-4)) and/or by mail to authorized AFN-BC television outlets outside the contiguous United States for their non-commercial distribution/presentation via television broadcast frequencies, encrypted, digitally compressed satellite transmission, and/or limited closed-circuit distribution systems. License Period: October 1, 2012 through May 31, 2013. CLIN 0002 (Option Year 1): TELEVISION PROGRAMMING - FFP Universal City Studios Productions shall provide the administrative effort required to authorize broadcast rights to its television programming aired on Bravo, E! Entertainment, G4, Oxygen, Style, SyFy, and USA Network for the American Forces Network - Broadcast Center (AFN-BC) to reproduce and distribute, provide live feeds or recorded copies of authorized programs and provide access to websites. AFN-BC will distribute the programming by encrypted, digitally compressed satellite transmission system (currently Cisco's PowerVu Plus (MPEG-4)) and/or by mail to authorized AFN-BC television outlets outside the contiguous United States for their non-commercial distribution/presentation via television broadcast frequencies, encrypted, digitally compressed satellite transmission, and/or limited closed-circuit distribution systems. License Period: June 1, 2014 through May 31, 2015. CLIN 0004 (Option Year 3): TELEVISION PROGRAMMING - FFP Universal City Studios Productions shall provide the administrative effort required to authorize broadcast rights to its television programming aired on Bravo, E! Entertainment, G4, Oxygen, Style, SyFy, and USA Network for the American Forces Network - Broadcast Center (AFN-BC) to reproduce and distribute, provide live feeds or recorded copies of authorized programs and provide access to websites. AFN-BC will distribute the programming by encrypted, digitally compressed satellite transmission system (currently Cisco's PowerVu Plus (MPEG-4)) and/or by mail to authorized AFN-BC television outlets outside the contiguous United States for their non-commercial distribution/presentation via television broadcast frequencies, encrypted, digitally compressed satellite transmission, and/or limited closed-circuit distribution systems. License Period: June 1, 2015 through May 31, 2016. CLIN 0005 (Option Year 4): TELEVISION PROGRAMMING - FFP Universal City Studios Productions shall provide the administrative effort required to authorize broadcast rights to its television programming aired on Bravo, E! Entertainment, G4, Oxygen, Style, SyFy, and USA Network for the American Forces Network - Broadcast Center (AFN-BC) to reproduce and distribute, provide live feeds or recorded copies of authorized programs and provide access to websites. AFN-BC will distribute the programming by encrypted, digitally compressed satellite transmission system (currently Cisco's PowerVu Plus (MPEG-4)) and/or by mail to authorized AFN-BC television outlets outside the contiguous United States for their non-commercial distribution/presentation via television broadcast frequencies, encrypted, digitally compressed satellite transmission, and/or limited closed-circuit distribution systems. License Period: June 1, 2016 through May 31, 2017. e. Delivery and acceptance will be made at: American Forces Nework - Broadcast Center (AFN-BC) 23755 Z Street Riverside, CA 92518-2031 f. FAR Provision 52.212-1 (Instructions to Offerors - Commercial Items) (Feb 2012) applies to this acquisition. Para (k) requires current registration in the Central Contractor Registration (CCR) database at http://www.ccr.gov. g. The Government intends to award a Firm Fixed-Price Commercial 5-Year Contract as a Sole Source Procurement to contractor Universal City Studios Productions LLLP (Universal City, CA) in accordance with 10 U.S.C. 2304(c)(1) & FAR Part 6.302-1 (Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements) for their exclusive rights television programming. The Justification for Other than Full and Open Competition is attached. h.
