- DEPARTMENT OF THE ARMY AND AIR FORCE JOINT FORCE HEADQUARTERS TENNESSEE NATIONAL GUARD HOUSTON BARRACKS, POST OFFICE BOX 41502 NASHVILLE, TENNESSEE 37204-1502 USPFO-PC-TN 4-May-12 Control No: 12C0002 Justification and Approval for 8(a) Sole Source Contract over $550K to $11.5 Million 1. Contracting Activity: W912L7 USPFO TN 3041 Sidco Drive, Suite 202, Nashville, TN 37204 2. Description of Action: Justification and Approval for a new contract for Non-personnel services for GIS and Target Repair Services. This firm fixed priced contract is funded by 2065 funds for the period of May1, 2012 to April 30, 2013. 3. Description of Supplies/Services: Non-personnel services for GIS and Target Repair Service is for an estimated total value, including options of $1,516,145.87. CLINS for travel reimbursement and Uniforms were not furnished at this point, but if needed will affect the total. 4. Authority Cited: Identify the statutory authority permitting other than full and open competition, followed by the FAR 6.203 Set-aside for small business concerns and 6.204 Section 8(a) competition under $20million. FAR 6.302-5 Authorized or required by statute. (a) Authority. (1) Citations: 10 U.S.C. 2304(c)(5) or 41 U.S.C. 253(c)(5). (2) Full and open competition need not be provided for when (i) a statute expressly authorizes or requires that the acquisition be made through another agency or from a specified source. (b) Application. This authority may be issued when statutes, such as the following, expressly authorize or require that acquisition be made from a specified source or through another agency: (4) Sole source awards under the 8(a) Program--15U.S.C. 637 (see subpart 19.8). 5. Reason for Authority Cited: Full and open competition need not be provided for when (i) a statute expressly authorizes or requires that the acquisition be made from a specified source. The potential contractors name is Elvado Environmental LLC Knoxville, TN, Cage Code 3EMF2. The specific requirements were recognized by SBA under NAICS code 541690. 6. Efforts to Obtain Competition: A Dynamic Small Business Search was conducted which revealed firms current with their 8(a)-certification or 8(a) Joint Venture that were small with capabilities under NAICS code: 541690;there were 18 profiles in Tennessee matching the criteria. There were 1678 profiles matching the same criteria with no state chosen. 7. Actions to Increase Competition: Mr. Thomas Baxter of Tactical Micro called with interest to provide services for this requirement. He was directed to the local SBA representative to help with the company's requirements in CCR and ORCA. No other competition was sought. 8. Market Research: A Dynamic Small Business Search was conducted which revealed firms current with their 8(a)-certification or 8(a) Joint Venture that were small with capabilities under NAICS code: 541690;there were 18 profiles in Tennessee matching the criteria. There were 1678 profiles matching the same criteria with no state chosen. 9. Interested Sources: Mr. Thomas Baxter of Tactical Micro called with interest to provide services for this requirement. He was directed to the local SBA representative to help with the company's requirements in CCR and ORCA. Legacy Corporation was interested in providing services, but the company has graduated from the 8(a) program. No other competition was sought, and to the date of this correspondence, no other sources have written to express an interest. 10. Other Facts: a. Procurement history (1) One company, Legacy Corporation, was awarded an 8(a) sole source contract, number W912L7-07-C-0007, when they were an 8(a) company with applicable NAICS codes and ability to perform. They have recently graduated past the 8(a) company and cannot perform under 8(a) requirements for a new contract. Legacy Corporation performed satisfactory. b. Acquisition data availability. Technical specifications for this requirement are in two Performance Work Statements (PWS) and will be provided specifically to the contractor awarded the requirement. d. Subcontracting competition. Elvado Environmental LLC is a small business, and no subcontracting requirements are allowed for in this requirement. 11. Technical Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief. Fair and Reasonable Cost Determination: Include the following determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. The basis for this determination includes an independent Government estimate, specific GS and WG wage grade scales, comparison of G&A, Profit, OH, and costs per hour of services were compared, and comparison of previous services provided by another contractor. As part of this basis, indicate whether certified cost or pricing data is not required and exceptions in FAR 15.403-1 (c) Standards for exceptions from certified cost or pricing data requirements- (1) Adequate price competition. A price is based on adequate price competition if (iii) Price analysis clearly demonstrates that the proposed price is reasonable in comparison with current or recent prices for the same or similar items, adjusted to reflect changes in market conditions, economic conditions, quantities, or terms and conditions under contracts that resulted from adequate price competition.
