- FDA1098838 Notice of Intent to Sole Source - Quality control kits for VIDAS instrumentation The Food and Drug Administration intends to modify an existing IDIQ contract (HHSF223201000032I) to Biomerieux Inc., 100 Rodolphe Street, Durham, NC 27712 in accordance with FAR Part 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. FDA currently has VIDAS instrumentation in place in the 9 laboratories being serviced. FDA requires quality control kits which are required by the manufacturer to be run on each instrument once a month and the kit is specifically designed for the VIDAS instrumentation. The QCV kits being requested are designed for the proper quality control and operation of specific, patented equipment. No other kit will satisfy the manufacturer requirement since no other kit is available for the purpose of quality control of this instrument. There is no interchangeability of this kit with any other kit on the market. This notice is not a request for competitive proposals. However, any party that believes it is capable of meeting this requirement as stated herein may submit a written capability statement that clearly supports and demonstrates their ability to provide the product. Capability statements must be received by the response date and time of this notice. Submissions will be reviewed to determine if they can meet the requirement. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. This procurement is being conducted under negotiated procedures in accordance with FAR Part 12 and Part 15. This action incorporates provisions and clauses that are in effect through Federal Acquisition Circulars 2005-48 Effective 31 Jan 2011. Response Date: 5:00 p.m. (Eastern Time), May 8, 2012.
