- THIS IS A NOTICE OF INTENT, NOT A SOLICITTION FOR COMPETITIVE PROPOSALS. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. The National Institutes of Health intends to negotiate on a sole source basis with Oblon, Spivak, McClelland, Maier & Neustadt, L.L.P.,1940 Duke Street, Alexandria, Virginia 22314. This contract provide for trademark-related services that may be required by the NIH Branch of the Office of General Counsel ("NIH-OGC") in its role as the Department's lead provider of intellectual property legal counseling. NIH-OGC provides trademark searching and counseling; filing and prosecution of trademark applications with the U.S. Patent and Trademark Office; international trademark procurement and prosecution; brand management and counseling; domestic and international trademark licensing; and pre-litigation counseling and dispute resolution. This sole source award is to prevent a lapse in service for an estimated two months period (estimated April 26, 2012 through June 26, 2012) during the negotiation and award of a new contract under solicitation number NIHOD2012307 for NIH Trademark Legal Services which was posted on www.fbo.gov on November 22, 2011. This action is under the authority 41 U.S.C 253(c)(1) as set forth in FAR 6.302-1, as it is impracticable to seek competition for the estimated two months period while negotiations under NIHOD2012307 are on-going. Based on the complexity and level of detail involved in dealing with these cases, it is not feasible for new contractors to assume responsibility for the trademark case load for such a brief period of time and meet the deadlines necessary for filing with the UPTO and foreign entities. This notice of intent is not a request for competitive proposals; however, if any other interested party believes it can meet the requirements, it may submit a statement of capability. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to allow the Government to determine if the party can meet all of the requirements of the Statement of Work and the terms and conditions of the current contract. (See Solicitation Number NIHOD2012307 referenced above for the statement of work). Capability Statements and related materials must be received by the Contract Specialist no later than 1 p.m. EST on April 26, 2012. A determination by the Government not to open the requirement to competition based upon responses to this notice is solely within the discretion of the Government. Information received as a result of the notice of intent will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
