- This is published as sole source announcement under the statutory authority at 10 USC2304(c) (1), and regulatory authority at FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Army Contracting Command, Aberdeen Proving Ground-Tobyhanna Division, Tobyhanna, PA 18466 intends to negotiate and award a contract for the repair and overhaul of the following Commercially Available of The Shelf (COTS) items on a sole source basis to Mercury Computer Systems, Inc. 201 Riverneck RD. Chelmsford, MA 01824-2820; Part Number/Description 900-23001Single Board Computer (SBC) PPC Card 12-0021/ CC395Mezzanine Card Requirements for the repair of these COTS items include Test, Evaluation and the actual repair or reset of the items to OEM specifications. It is anticipated that this requirement is for a one year base period of performance and will include two, one year options for additional repair and overhaul support. The Government does not have the required technical data package to pursue a competitive acquisition. Mercury Computer Systems, Inc. is the sole designer, developer and manufacturer of the listed COTS items, and owns the proprietary rights, hardware schematics and data rights. Due to the electronic complexities, proprietary components of the items, and the ability to perform repair or overhaul on all available COTS items, Mercury Computer Systems, Inc. is the only contractor who can provide the testing, overhaul and repair on the COTS items. Mercury Computer Systems, Inc. is the only established contractor with past proven performance and the ability to immediately begin testing, overhaul and repair efforts. Any firms believing they can provide the requirements and services for the testing, overhaul and repair on the listed COTS items should contact the Contract Specialist identified below within fifteen (15) days of this notice and submit a capabilities statement which will be reviewed for consideration.
