- The U.S. Securities and Exchange Commission (SEC) intends to award a sole source purchase order to Caldwalader, Wickersham and Taft, LLP for a subscription to Lofchie’s Guide to Broker-Dealer Regulation 4th Edition. SEC requires Commission-wide access via the Internet. The publication shall include implications for broker-dealers stemming from the Dodd-Frank Act, new rules governing direct access trading regulation, a summary of portfolio margin rules, an explanation of the issues with respect to the use of expert systems, and explanation of the legislative history and policy considerations behind key rules. Caldwalader, Wickersham and Taft, LLP is the only known vendor capable of providing the data that is required by the Commission. The period of performance for this purchase order is for twelve (12) months from March 30, 2012 through March 29, 2013. The statutory authority permitting other than full and open competition is 41 U.S.C. 253 (c) (1), implemented by FAR 6.302-1 – Only one responsible source and no other supplies or services will satisfy agency requirements. The SEC intends to negotiate with only one source under authority of FAR 6.302-1. Interested organizations may submit their capability statements and qualifications for the provision of this requirement. Information received will be considered solely for the purpose of determining whether to conduct future competitive procurements. This is a Notice of Intent, not a solicitation. No solicitation will be issued for this sole source requirement and no other information will be provided.
