Description
NOTICE OF PROPOSED CONTRACT ACTION (NOPCA): The Cryptologic Systems Division (CPSD) Contracting Branch, HNCKA, Lackland AFB, San Antonio, TX, intends to award on a sole source basis a firm-fixed-price contract for the production of Miniature COMSEC Units (MCU) 110B Products. The Government intends to procure the MCU-110B Product, including flight units, 28 each and engineering units, 10 each. The MCU-110B was developed by the Original Equipment Manufacturer (OEM) L-3 Telemetry West (TW), 9020 Balboa Avenue, San Diego, CA. 92123, CAGE CODE: 9U244, as a propriety product and received National Security Agency (NSA) certification as a Type-1 CRYPTO unit under the NSA Commercial COMSEC Endorsement Program (CCEP). The proposed contract action is for supplies for which the Government intends to solicit and negotiate with only one source IAW 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, only one (1) responsible source. The Air Force's lack of complete specifications, schematics/drawings, parts lists and technical expertise precludes the use of Full and Open Competition procedures to satisfy this requirement. L-3 TW is the only vendor known to the Air Force capable of producing the MCU-110B units, because as the OEM it has the required engineering knowledge, expertise, and complete drawing package to do so. An ESC Ombundsman has been appointed to consider and facilitate the resolution of concerns from offerors, potential offerrors, and others for this acquisition. Before consulting the Ombudsman, concerned parties should first address their concerns, issues, disagreements, and/or recommendations to the Contracting Officer for consideration. IAW AFFARS 5352.201-9101, the ability to contact an Ombudsman, will be included in this acquisition's solicitation and contract. Those interested firms must indicate whether they are a large, small, and small-disadvantaged, 8(a), or women owned business and whether they are U.S. or foreign owned.
