Description
The purpose of this amendment (0002) is to update Section B. The purpose of this amendment (0001) is to update Section C. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation is being issued as a Request for Quote (RFQ); solicitation number is H92244-12-T-0114. Federal Acquisition Circular (FAC) 2005-55 effective 02 February 2012. The North American Industrial Classification Code (NAICS) 485999 with a standard business size of $7.0M applies to this procurement. This procurement is set-aside for small business concerns. The DPAS rating for this procurement is DO-S10. All responsible sources may submit a quote which shall be considered by the agency. FUNDS ARE NOT CURRENTLY AVAILABLE FOR THIS PROCUREMENT AND ARE SUBJECT TO FAR 52.232-18 -- Availability of Funds (Apr 1984) Funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer. Section B Schedule of Supplies and Services: CLIN 0001, Description: Transportation Services, Qty: 1, Unit of Issue: Lump Sum; Extended Description: The contractor shall provide transportation services for command members for the period of 1 April 2012 through 30 September 2012. This CLIN shall include the following estimated amount of service: - Pick-Up Fee - Qty: 600 estimated call; - Per Mile Rate for each mile up to 15 miles - Qty: 3,300 miles; - Per Mile Rate for each mile in excess of 15 miles - Qty: 1,260 miles; - Fee for Additional Passengers (standard fee) - Qty: 1; - Cancellation/No-Show Policy (The contractor shall provide a cost of what the pick-up fee will be charged if services are cancelled after the driver has been dispatched - Qty: 1; OPTION CLIN 1001, Description: Transportation Services, Qty: 1, Unit of Issue: Lump Sum; FUNDS ARE NOT CURRENTLY AVAILABLE FOR THIS CLIN AND ARE SUBJECT TO FAR 52.232-18 -- Availability of Funds (Apr 1984) Extended Description: The contractor shall provide transportation services for command members for the period of 1 October 2012 through 30 September 2013. This CLIN shall include the following estimated amount of service: - Pick-Up Fee - Qty: 1,200 estimated call; - Per Mile Rate for each mile up to 15 miles - Qty: 6,600 miles; - Per Mile Rate for each mile in excess of 15 miles - Qty: 2,520 miles; - Fee for Additional Passengers (standard fee) - Qty: 1; - Cancellation/No-Show Policy (The contractor shall provide a cost of what the pick-up fee will be charged if services are cancelled after the driver has been dispatched - Qty: 1; FOB: Origin Section C Description (see attached Statement of Work) The contractor shall provide transportation services for specific command military members in the South Hampton Roads area (Virginia Beach, Chesapeake, Portsmouth and Norfolk) to their residences. Only military personnel currently assigned to the command are authorized to utilize these services. The contractor shall provide transportation services that include moving the individual and his/her vehicle to their residence simultaneously. The vendor must be able to respond to a call and pick-up the individual within 30-60 minutes of the call. Contractor Personnel. The contractor shall provide fully licensed and insured driver to transport the authorized command member in their own vehicle from any location in South Hampton Roads to their residence. The contractor shall be fully licensed and insured inaccordance with all Federal, State and Local laws and regulations. Hours of operation. At a minimum the contractor will be required to provide services from 2100 to 0200 every day of the week. Contractor's Vehicle. The contractor shall ensure that all vehicles are licensed, insured, registered, and inspected in accordance with all applicable state and local laws. Transportation used to provide these services will not constitute vehicles owned or leased by the command or the Navy. Ordering Procedures. Command members shall be issued bar-coded cards (by the contractor) unique to the individual with the company's contact information. The vendor will be contacted by the command member for services. The command member will identify themselves as a military member of the command. Once the driver arrives the command member will be required to verify his/her affiliation with the command. The contractor will then be required to transport the command member and his/her vehicle to their residence.. Monthly or Bi-MonthlyBilling. The contractor will invoice once a month with a break out of each instance of service listing at a minimum the following: the command members name, date of service, breakout of charges for each ride, origin and destination of pickup/drop off. The contractor shall be responsible for tracking and monitor expenditures under this contract and shall only invoice for services that are received by the government. Pricing. (End of Clause) FAR 52.209-5 -- Certification Regarding Responsibility Matters. (b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances. (c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible. (d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings. (e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default. (End of Provision) FAR 52.209-7 - Information Regarding Responsibility Matters (Apr 2010) (a) Definitions. As used in this provision- "Administrative proceeding" means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceeding at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables. "Federal contracts and grants with total value greater than $10,000,000" means- (1) The total value of all current, active contracts and grants, including all priced options; and (2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules). (ii) In a civil proceeding, a finding of fault and liability that results in the payment of a monetary fine, penalty, reimbursement, restitution, or damages of $5,000 or more. (2) If the offeror has been involved in the last five years in any of the occurrences listed in (c)(1) of this provision, whether the offeror has provided the requested information with regard to each occurrence. (d) The offeror shall enter the information in paragraphs (c)(1)(i) through (c)(1)(iv) of this provision in FAPIIS as required through maintaining an active registration in the Central Contractor Registration database at http://www.ccr.gov (see 52.204-7). "Principal" means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions). (End of provision) FAR 52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers indescending order of importance. (i) Technical - Offeror shall provide a detailed quote outlying how it intends to meet the requirements of this solicitation to include but not limited to: proposed method of transportation, fleet size, operations detail, etc...The vendor must be authorized and licensed to operate in the areas listed in the SOW. Offerors must scrutinize this solicitation and ensure their quote and submissions comply with all requirements. It is not sufficient to merely state your quote complies with the solicitation requirements. You must clearly identify how your quote meets ALL of the solicitation requirements. (ii) Past Performance - Offerors shall provide name, title, and phone number of principal for no less than three prior or current contracts/agreements for similar scoped projects performed during the previous three years. To be technically acceptable, the submitting offeror must submit relevant and current past performance in ALL areas noted in this combined synopsis/solicitation. The Government will evaluate each offeror's experience on the basis of its depth and its relevance to the work that will be required under the prospective contract. (iii) Price - The vendor shall provide pricing on all of the line items in Section B. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. SOFARS 5652.201-9002 AUTHORIZED CHANGES ONLY BY CONTRACTING OFFICER (JAN 2005) The Contractor shall not comply with any order, direction or request of Government personnel unless it is issued in writing and signed by the Contracting Officer, or is pursuant to specific authority otherwise included as part of this contract. Except as specified herein, no order, statement, or conduct of Government personnel who visit the contractor's facilities or in any other manner communicates with Contractor personnel during the performance of this contract shall constitute a change under the Changes clause in Section I. In the event the Contractor effects any change at the direction of any person other the Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in cost incurred as a result thereof. SOFARS 5652.233-9000 Independent Review of Agency Protests (2005) All protests shall be submitted through the Contracting Officer. A request for an independent review of the protest decision may be made to the Chief of Contracting. Submit request in accordance with FAR 33.104(d) (4) to: Naval Special Warfare Development Group, Chief of Contracting, (N72), 1636 Regulus Avenue, Virginia Beach, Virginia 23461-2299, Fax (757) 893-2957. No direct discussion between the technical representative and a prospective offeror will be conducted unless it is deemed necessary by the Contracting Officer. Questions shall be sent via email to Kenneth Brumfiel. The offeror agrees to hold the prices in its quote firm for 180 calendar days from the date specified for receipt of quotes. Only complete quotes will be considered for award. If you have previously provided a quote please resubmit in accordance with this solicitation. Offerors must scrutinize this solicitation and ensure their quote and submissions comply with all requirements. It is not sufficient to merely state your quote complies with the solicitation requirements. You must clearly identify how your quote meets ALL of the solicitation requirements.
