Description
This is an advance notice announcing the intent of the Seattle District US Army Corps of Engineers to award a sole-source firm fixed price contract with a base and four option years to the Salish-Kootenai College, Hwy 93 N, Pablo, Montana, an educational institution affiliated with the Confederate Salish and Kootenai Tribes of the Flathead Reservation (CSKT). The contract will procure curation services including professionally monitored storage, maintenance, and supervision of cultural resource collections from the Libby Dam Project, comprising cultural materials and their associated documentation. Materials consist of artifacts, soil samples, charcoal, skeletal material, works of art, and other archaeological elements. Action is authorized by 10 U.S.C. 2304 (c)(1), or 41 U.S.C. 253 (c)(1), FAR 6.302-1 (iii) entitled "only one responsible source and no other suppliers or services will satisfy agency requirements." Pursuant to the Native American Graves Protection and Repatriation Act (NAGPRA, Public Law 101-601, 25 U.S.C. 3001-3013, and 104 Stat. 3048-3058) (Regulation at 42 C.F.R. Part 10), the Kootenai Tribe component of the CSKT is the designated representative for Native American tribes with NAGPRA jurisdiction over collections at the project on lands ceded under Article 1 of the Hellgate Treaty of 1855. Additionally, the action is pursuant to the following: The National Historic Preservation Act of 1966, as amended, The Reservoir Salvage Act of 1960, as amended. ER 1130-2-433, Collections Management and Curation of Archaeological and Historical Data. The Libby Dam Cultural Resources Curation Letter Report approved 19 December 1988. The Corps of Engineers has a special trust relationship with Indian tribes whose tribal lands or ceded lands are in project areas, particularly with respect to NHPA and NAGPRA. This project is entirely within the CSKT ceded lands. The CSKT is the sole representative for Native American tribes with NAGPRA jurisdiction at the site. Due to the project's geographic location and trust relationship with the CSKT, there is no other authorized organization capable of performing NAGPRA services. This action is in accordance with NAGPRA provisions at 43 CFR Part 10, Subpart B governing Agency action regarding Human Remains, funerary objects, sacred objects, or objects of cultural patrimony from Federal or Tribal Lands. All collected materials not subject to NAGPRA review are personal property under the ownership of the Government. The North American Industry Classification System (NAICS) Code is 611310 with a size standard of $7 million.
