- This contract action was accomplished using other than competitive procedures because the procurement is awarded to a sole source under the Test Program for Certain Commercial Items (FAR 13.5). See posted J&A for further information. PRIORITY 3 ACQUISITION MEMORANDUM FOR RECORD FOR OTHER THAN FULL AND OPEN COMPETITION BELOW THE SIMPLIFIED ACQUISITION THRESHOLD 1. Contracting Agency: Southern Regional Contracting Office - West, Brooke Army Medical Center (BAMC), Fort Sam Houston, TX 78234 2. Description of Action: Urgent procurement of LC Surgical Lighting System for the Trauma Rooms to perform surgery on patients in Emergency Room. 3. Description of Products/Services: The LC Surgical Lighting System includes monitors, arms and lights needed by physicians and support staff to accurately see and treat trauma sites. 4. Authority Cited: -Pursuant to FAR Part 13.106-1(b)(1), Soliciting competition. For purchases not exceeding the simplified acquisition threshold, contracting officer may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency). -Pursuant to FAR Part 5.202(a)(2), Exceptions. The unusual and compelling requirement will not be advertised. -Pursuant to FAR Part 13.106(c)(1), Soliciting competition. Price and availability will be obtained telephonically. 5. Reason for Cited Authority: The above statutory authority is cited because this is a true, urgent request that has been verified by _Janet Rindorf___ on _07 Mar 2012_. The current lighting system in place in the emergency room has failed and patients are no longer able to be taken care of in the main trauma room. The LC Surgical Lighting System is needed urgently for a patient in the Trauma Room ER scheduled on _12 Mar 2012_. LC Surgical Lighting System is needed to provide the proper lighting for the doctors to perform their surgeries on patients that come into the hospital with trauma. Without the proper lighting could in danger the patient's life as well as the hospital's overall medical mission. 6.Contracting Officer Certification: I certify this justification is accurate and complete to the best of my knowledge and belief.
