AMENDMENT NOTICE:This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.The solicitation number is RFQP0217A1 and is issued as an invitation for bids (IFB), unless otherwise indicated herein.The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-56. The associated North American Industrial Classification System (NAICS) code for this procurement is 335211 with a small business size standard of 750.00 employees.This requirement is a [ Small Business ] set-aside and only qualified offerors may submit bids.The solicitation pricing on www.FedBid.com will start on the date this solicitation is posted and will end on 2012-03-13 11:00:00.0 Eastern Time or as otherwise displayed at www.FedBid.com.FOB Destination shall be Philadelphia, PA 19106 The Federal Bureau of Prisons requires the following items, Meet or Exceed, to the following: LI 001, Steam Kettle: 80 Gallon, natural gas fired, fully jacketed steam kettle, Dome lid w'drop handle, 3" draw strainer, Vacuum pressure relief valve, low water cut off, adjustable legs w/flanged feet, dish shaped interior, pressure limit swith,faucet bracket, Must meet NSF and ASME Code, 2, EA; Solicitation and Buy Attachments ***Question Submission: Interested offerors must submit any questions concerning the solicitation at the earliest time possible to enable the Buyer to respond. Questions must be submitted by using the 'Submit a Question' feature at www.fedbid.com. Questions not received within a reasonable time prior to close of the solicitation may not be considered.*** For this solicitation, Federal Bureau of Prisons intends to conduct an online competitive reverse auction to be facilitated by the third-party reverse auction provider, FedBid, Inc. FedBid has developed an online, anonymous, browser based application to conduct the reverse auction. An Offeror may submit a series of pricing bids, which descend in price during the specified period of time for the aforementioned reverse auction. Federal Bureau of Prisons is taking this action in an effort to improve both vendor access and awareness of requests and the agency's ability to gather multiple, competed, real-time bids.All responsible Offerors that respond to this solicitation MUST submit the pricing portion of their bid using the online exchange located at www.FedBid.com. There is no cost to register, review procurement data or make a bid on www.FedBid.com.Offerors that are not currently registered to use www.FedBid.com should proceed to www.FedBid.com to complete their free registration. As used in this clause--"Commercially available off-the-shelf (COTS) item"--(1) Means any item of supply (including construction material) that is--(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);(ii) Sold in substantial quantities in the commercial marketplace; and(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is soldin the commercial marketplace; and(2) Does not include bulk cargo, as defined in section 3 of the Shipping Act of 1984 (46 U.S.C. App. 1702), such as agriculturalproducts and petroleum products."Component"means an article, material, or supply incorporated directly into an end product."Cost of components"means--(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation intothe end product (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificateis issued); or(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportationcosts as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components doesnot include any costs associated with the manufacture of the end product."Domestic end product means"--(1) An unmanufactured end product mined or produced in the United States;(2) An end product manufactured in the United States, if--(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components.Components of foreign origin of the same class or kind as those that the agency determines are not mined, produced, or manufacturedin sufficient and reasonably available commercial quantities of a satisfactory quality are treated as domestic. Scrap generated,collected, and prepared for processing in the United States is considered domestic; or(ii) The end product is a COTS item."End product"means those articles, materials, and supplies to be acquired under the contract for public use."Foreign end product"means an end product other than a domestic end product."United States"means the 50 States, the District of Columbia, and outlying areas.(b) The Buy American Act (41 U.S.C. 10a - 10d) provides a preference for domestic end products for supplies acquired for use in theUnited States. In accordance with 41 U.S.C. 431, the component test of the Buy American Act is waived for an end product that is aCOTS item (See 12.505(a)(1)).(c) Offerors may obtain from the Contracting Officer a list of foreign articles that the Contracting Officer will treat as domestic for thiscontract.(d) The Contractor shall deliver only domestic end products except to the extent that it specified delivery of foreign end products inthe provision of the solicitation entitled?Buy American Act Certificate."(End of clause) Faith-based and Community-based organizations can submit offers/bids/quotations equally with other organizations for contracts for which they are eligible. [End of Provision] (a) Definition. "Small business concern,"as used in this clause, means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the size standards in this solicitation. (b) General. (1) Offers are solicited only from small business concerns. Offers received from concerns that are not small business concerns shall be considered nonresponsive and will be rejected. (2) Any award resulting from this solicitation will be made to a small business concern. (c) Agreement. A small business concern submitting an offer in its own name shall furnish, in performing the contract, only end items manufactured or produced by small business concerns in the United States or its outlying areas. If this procurement is processed under simplified acquisition procedures and the total amount of this contract does not exceed $25,000, a small business concern may furnish the product of any domestic firm. This paragraph does not apply to construction or service contracts. (End of clause) (a) This clause applies to the extent that this contract involves access to information classified "Confidential,""Secret,"or "Top Secret." (b) The Contractor shall comply with- (1) The Security Agreement (DD Form 441), including the National Industrial Security Program Operating Manual (DoD 5220.22-M); and (2) Any revisions to that manual, notice of which has been furnished to the Contractor. (c) If, subsequent to the date of this contract, the security classification or security requirements under this contract are changed by the Government and if the changes cause an increase or decrease in security costs or otherwise affect any other term or condition of this contract, the contract shall be subject to an equitable adjustment as if the changes were directed under the Changes clause of this contract. (d) The Contractor agrees to insert terms that conform substantially to the language of this clause, including this paragraph (d) but excluding any reference to the Changes clause of this contract, in all subcontracts under this contract that involve access to classified information.
