Description
This is a combined synopsis/solicitation for the commercial item identified below, prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation VA-256-12-R-0556 is being issued as an unrestricted Request for Proposal (RFP) and incorporates provisions and clauses that are in effect through Federal Acquisition Circular 2005-55. The North American Industry Classification System Code (NAICS) is 623110 with the small business size standard of $13.5 million. The Department of Veterans Affairs, Alexandria VA Health Care System, Alexandria, Louisiana, Social Work Service Contract Nursing Home Program under Statutory Authority 41 USC 253 (c)(5) and 38 U.S.C. 1720 anticipates entering into acquisition negotiations and award of a Basic Ordering Agreement for placement and services of eligible veterans into a nursing home facility located within 10 miles of the center of Pollock, Louisiana. This authority is cited and justification made based on the determination that the Government's minimum needs can best be satisfied by services available in this location. This solicitation will be available only via the Federal Business Opportunities website (www.fedbizopps.gov). All Offerors MUST be registered and verified in the Central Contractor Registration (CCR) database. STATEMENT OF WORK DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK A.TERM AND LIMITATIONS OF THE CONTRACT: This Basic Ordering Agreement is effective for a Base Year period, 04/01/2012 - 3/31/2013, with four (4) Option Years. Award of option years is at the sole discretion of the Government. However, renewal is subject to the availability of funds. Therefore, no services shall be performed in any option year until authorized by the Contracting Officer. B.PURPOSE The Department of Veterans Affairs, Alexandria VA Health Care System, Alexandria, Louisiana, Social Work Service Contract Nursing Home Program procurement requirement is to obtain a nursing home care provider within 10 miles of the center of Pollock, Louisiana for the care of veterans in the Alexandria, Louisiana in support of Alexandria VA Health Care System goals to: (1) provide care for VA beneficiaries who are temporarily or permanently unable to care for themselves, but who do not require the level of care furnished in an acute care hospital; (2) provide some level of patient choice in choosing a nursing home at some distance from a VA Medical Center or clinic, but close to the veterans' home, family and community. C.BACKGROUND Through the Contract Nursing Home Program, the VA provides nursing home placement to eligible Veterans to meets the health needs to include: total medical, nursing, and psychosocial service and promoted the maximum well-being of the VA beneficiaries in areas of the state where the veteran may be close to home or relatives. Every effort shall be made to keep patients ambulatory and to achieve an optimal level of self care. VHA continues to be committed to building capacity to serve the long-term care needs of veterans through home and community-based care (H&CBC), State Veterans Homes, and the CNH Program. VHA also recognizes the rising concerns over quality of care in the nation's nursing homes and the need to fully implement a plan for quality monitoring. D.SERVICES TO BE PROVIDED The Contractor shall ensure that care meets the health needs and promotes the maximum well being of VA patients. The Contractor shall furnish care to ensure the total medical, nursing, and psychosocial needs of VA beneficiaries. Physician visits, laboratory, x ray, and other special services for VA patients shall be at the same frequency as that provided to other patients at the Contractor's facility receiving the same or comparable level of care. In addition, the care provided shall include room, meals, nursing care, and other services or supplies commensurate with the VA authorized level of care, without extra charge. The per diem rate(s) established in this contract will include the cost of medical care, emergency dental care, laboratory, x ray, and other special services authorized by VA, unless otherwise specifically accepted. The Contractor must have and maintain a Louisiana Department of Health Nursing Facility License. Full attention shall be given to motivating and educating patients to achieve and maintain independence in the activities of daily living. Every effort shall be made to keep patients ambulatory and to achieve an optimal level of self care. Absences of the patient from the Contractor's facility in excess of 48 hours shall not be reimbursable except with prior approval of the placing VA facility. Patients receiving care under this contract, who begin to require more than the level of care authorized by VA, shall be readmitted to an appropriate VA facility, as determined and authorized by VA. When such admission is not feasible because of the nature of the emergency, it is agreed that hospitalization in a non-federal facility shall be accomplished provided VA authorization is obtained. VA authorization shall be obtained within 72 hours of admission of the patient to a non Federal facility. If hospitalization of a non emergency nature is required, it is agreed that readmission to a VA Medical Center shall be accomplished as soon as the patient's condition is sufficiently stabilized to permit admission to VA. In the event a VA beneficiary receiving Contractor care under this contract dies, the Contractor shall promptly notify the VA office authorizing admission and immediately assemble, inventory, and safeguard the patient's personal effects. The funds, deposits, and effects left by VA patients upon the premises of the Contractor shall be delivered by the nursing to the person or persons entitled thereto under the laws currently governing the Contractor for making disposition of funds and effects left by patients, unless the beneficiary died without leaving a will, heirs or next of kin capable of inheriting. When disposition has been made, the itemized inventory with a notation as to the disposition of the funds and effects will be immediately forwarded to the VA office authorizing admission. Should a deceased patient have no will, heirs, or next of kin, his/her personal property and funds wherever located vests in and becomes the property of the United States in trust. In these cases the Contractor shall forward inventory of any such property and funds in its possession to the VA office authorizing admission, and shall hold them (except articles of clothing necessary for proper burial) under safeguard until instructions are received from VA concerning disposition. The Contractor shall not maintain nor provide dual or segregated patient facilities that are segregated on the basis of race, creed, color, or national origin. The Contractor shall neither require such segregated use by written or oral policies, nor tolerate such use by local custom. The term facilities shall include but not be limited to rooms, wards, sections, eating areas, drinking fountains, entrances, and other like areas. It is agreed that VA will have the right to inspection of the Contractor's facility and all appurtenances by authorized VA representative(s) to ensure that acceptable standards are maintained and that the necessary care to maintain the well being of the patient is rendered. The Contractor shall accept referral of and shall provide all services specified in this contract for any person determined eligible by the VA Under Secretary for Health or his/her designee, regardless of the race, color, religion, sex, or national origin of the person for whom such services are ordered. In addition, the Contractor warrants that subcontracting shall not be resorted to as a means of circumventing this provision. It is agreed that duly authorized representatives of VA will provide follow up supervision visits to veterans placed to assure the continuity of care and to assist in the veteran's transition back to the community. It is understood that these visits do not substitute for nor relieve the Contractor in any way of the responsibility for the daily care and medical treatment of the veteran. All medical records concerning the veteran's care in the Contractor's facility will be readily accessible to VA. Upon discharge or death of the patient, medical records will be retained by the Contractor for a period of at least three years following termination of care. Patient records will be maintained in conformance with the Privacy Act of 1974 (5 U.S.C. 552a). A medical record shall be maintained for each patient that includes at least the following: 1)Admission identification record. 2)VA Form 10 1204, Referral for Community Nursing Home Care. 3)Admitting evaluation (including diagnosis by Contractor's physician). 4)Physician orders. 5)Progress notes. The physician orders/notes shall be charted immediately after patient is seen. 6)Special reports (laboratory, x-ray, activity, etc.). 7)SMA Patient Assessment Form (****only if SMA level of care is used****). 8)Minimum Data Set (MDS) information, provided to VA upon admission and every six months thereafter when VA's electronic system becomes available. The beneficiary will be provided care the Contractor's facility at the expense of VA for a period not in excess of that stated in the nursing care and treatment plan received from VA unless an extension of the authorization is provided in writing by the placing VA facility. The authorization agreement, VA Form 10 7078, for the affected patient will terminate whenever a VA patient is re-hospitalized for 15 calendar days or more, whether in a VA or in a non Federal facility. A new authorization agreement will be required at the time the patient returns. Level of Care Classification Effective Records: The level of care classification and associated per diem rate will remain in effect for each placement until and unless one of the following events takes place: 1)The recipient is discharged and subsequently qualifies for a new admission assessment. 2)The Contractor submits an assessment requesting a change in the level of care classification and VA approves it. Classification changes may also occur based on a determination by VA. VA will make the determination whether classification changes require readmission to VA. The VA, at its sole option, will monitor the professional care and administrative management of services provided to VA beneficiaries under this agreement, through one or any combination of the following methods; reviews of state agencies reports, on-site inspection of the Contractor's facility by VA staff, and/or on-site monitoring of VA patients. It is agreed that the Contractor shall provide VA with copies of all state agency reports when requested, and cooperate fully with VA's quality improvement-quality assurance program functions relating to this agreement, including VA's on-site inspection and monitoring. In addition, the Contractor warrants that subcontracting will not be resorted to as a means of circumventing this provision. The VA Contracting Officer shall make all final determinations as to the contractor's reasonable cooperation with VA and compliance with these requirements. E.SPECIAL CONTRACT REQUIREMENTS 1)TERMINATION OF SERVICES: VA reserves the right to remove any or all VA patients from the nursing home at any time when it is determined to be in the best interest of the Department of Veterans Affairs or the patients, without additional costs to the Government. 2) EXTENSION OF AGREEMENT This agreement may be extended for four (4) one-year periods at the option of the Government in accordance with FAR Clause 52.217-9, Option to Extend the Term of the Contract. Notice of an extension must be served in writing by the Government thirty days prior to the scheduled expiration date. The extension is granted subject to the availability of funds. 3)INVOICES All invoices to the Alexandria VA Health Care System shall be submitted promptly to the address below by the 15th calendar day following the end of the month in which services were rendered. All invoices must include the full name and address of the nursing home and shall reflect the patient's name, social security number, number of days billed, level of care category, and per diem rate. Failure to include this information may result in delayed payments. Invoice for the Alexandria VA Health Care System facility shall be sent to the following address: Department of Veterans Affairs Alexandria VA Health Care System Attn: Social Work Service (122) PO Box 69004 Alexandria, LA 71306-9004 Should a placement be made by another VA Medical Center, the invoice will go to that facility for the first 90 days and afterwards, will go to the above address. 4)PAYMENTS Payment made by the VA under this agreement constitutes the total cost of nursing home care. No additional charges will be billed to Medicare Part B, the beneficiary or his/her family, either by the nursing home or any third party furnishing services or supplies required for such care, unless and until specific prior authorization, in writing, is obtained from the VA facility authorizing payment. The contractor will not solicit contributions, donations, or gifts from patients or family members. 5)ACCEPTABLE SAFETY AND SANITATION PRACTICES Acceptable safety and sanitation practices shall be observed throughout the facility. The building shall conform to the standards of the Life Safety Code (National Fire Protection Association Standard #101) in effect on the date of agreement award. 6)MINIMUM QUANTITIES It is impossible to determine the exact or estimated amount which will be expended under this agreement. No obligation will be incurred by the VA under this agreement until authorizations are issued for nursing home care of specific beneficiaries. The VA agrees to make payment on a timely basis for services rendered in accordance with such authorizations upon receipt of proper invoices submitted by the Contractor in this agreement. The VA will make payment for the day a recipient enters the facility but not the day the recipient leaves a facility unless entrance and departure are on the same day. In this event, payment will be made for one day. 7)MEDICARE/MEDICAID STANDARDS The contractor is required to follow Medicare/Medicaid standards for all VA placements, except Life Safety. Medicare and Medicaid clinical and program standards are found in 42 CFR 483. The VA does not accept waivers from nursing service standards. 8)LIFE SAFETY CODE CLAUSE: The administrator of your facility is required to notify the VA Contracting Officer at least 3 days prior to any planned facility changes that could impact the Life Safety Code and other safety features of the facility, which were in existence at the time this contract was issued. The VA Contracting Officer will notify the VA Fire Safety Officer responsible for the Life Safety Code inspection of your facility and he/she will review (inspect the facility if required) the proposed changes and provide necessary approval/disapproval of your facility to house veterans during and/or after the proposed changes. Examples of facility change (but not limited to) that require VA Contracting Officer notification are as follows; interior finish, corridor partitions/walls, patient room doors, linen/trash chutes, exits, emergency lighting, fire alarm systems, automatic sprinklers, smoke barrier walls/doors, oxygen systems, compressed gas storage, HVAC, electrical and fuel gas systems F.CONTRACT CHANGES/TECHNICAL DIRECTIONS The Contracting Officer is the only person authorized to approve changes or modify any of the requirements of this contract. The Contractor shall communicate with the Contracting Officer on all matters pertaining to contract administration. Only the Contracting Officer is authorized to make commitments or issue changes that shall affect price, quantity or quality of performance of this contract. IN THE EVENT THE CONTRACTOR AFFECTS ANY SUCH CHANGE AT THE DIRECTION OF ANY PERSON OTHER THAN THE CONTRACTING OFFICER WITHOUT AUTHORITY, NO ADJUSTMENT SHALL BE MADE IN THE CONTRACT PRICE TO COVER AN INCREASE IN COSTS INCURRED AS A RESULT THEREOF. The COTR will be responsible for the overall technical administration of this contract as outlined in the COTR Delegation of Authority, including monitoring of the Contractor's performance. This solicitation document incorporates the following provisions, clauses and addendums as in effect through Federal Acquisition Circular (FAC) 2005-55B. CLAUSES/PROVISIONS: Offerors are required to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items (April 2011), with its offer. The clause at 52.212-4, Contract Terms and Conditions - Commercial Items (June 2010), applies to this acquisition with the following clauses added as addenda to the clause: 52.216-18 Ordering, 52.216-19 Order Limitations, 52.216-22 Indefinite Quantity, 52-217-8, Option to Extend Service (Nov 1999), 52.217-9 Option to Extend the Term of the Contract, VAAR 852.203-70 Commercial Advertising, VAAR 852.203-71 Display Hotline Poster; VAAR 852.215-70 SDVOSB and VOSB Evaluation Factors; VAAR 852.215-71 Evaluation Factor Commitments; VAAR 852.237-7 Indemnification and Medical Liability Insurance VAAR 852.216-70 Estimated Quantities, VAAR 852.237-70 Contractor Responsibilities, VAAR 852.271-70 Nondiscrimination in Services Provided to Beneficiaries, VAAR 852.273-76 Electronic Invoice Submission, 52.224-1 Privacy Act Notification, 52.224-2, and Privacy Act.. 52.212-5 Contract Terms And Conditions Required To Implement Statutes Or Executive Orders--Commercial Items applies to this acquisition and the additional FAR clauses cited in the clause are paragraphs (b) 1, 4, 6, 10, 14, 16, 23, 26, 28, 29, 30, 31, 32, 33, 34, 38, 41, 42, and 48 and paragraph (c) 1, 2, and 3. PROVISIONS: 52.216- Type of Contract, 52.233-2 Service of Protest, and VAAR 852.233-70 Protest Content/Alternative Dispute Resolution, 52.216-27, Single or Multiple Awards, and 52.225-25 Prohibition of Contracting with Entities Engaging in Sanctioned Activities Relating to Iran-Representation and Certification. The Government shall award a contract resulting from this solicitation to the responsive/responsible offeror/s whose offer conforming to the solicitation will be most advantageous to the Government per FAR 13.106-2. Responses shall include technical specifications, descriptive material, and other such information corresponding to each minimum required item, which demonstrates the Offeror's capabilities, and shall identify where the offered service meets or does not meet each of the Governments functional and performance minimum specifications listed herein.
