- This acquisition is 100% set aside for Small Buy Indian Owned Business under the authority of 26 U.S.C. Economic enterprises that are not at least fifty one percent owned by a Native American or Alaskan Native, or Triballyl-owned may not offer quotes in response to this notice and any quotes submitted by other than Indian owned businesses shall not be considered. Quotes shall certify that they are Indian owned. Indian Economic Enterprises means (i) any business activity owned by an Indian or an Indian Tribe that is established for the purpose of profit provided that such Indian or Indian Tribe ownership shall constitute not less than 51 percent of the enterprise, and that the Indian or Indian Tribe shall receive a majority of the earnings from the contract, to include entities pursuant to the Native Claims Settlement Act, 43 USC 1601 and 43 USC 1626(e)(1) and (2); and (ii) the management and daily business operations of an eligible Indian economic enterprise must be controlled by one or more individuals who are members of an Indian Tribe. The individuals must possess requisite management or technical capabilities directly related to the primary industry in which the firm conducts business. The enterprise must meet these requirements throughout these time periods: (1) At the time an offer is made in response to a written solicitation; (2) at the time of contract award; and (3) during the full term of the contract. Indian Tribe means an Indian Tribe, band, nation, or other recognized group or community which is recognized as eligible for the special programs and services provided by the United States to Indians because of their status as Indians, including any Alaska Native village, urban, or corporation pursuant to the Alaska Native Claims Settlement Act (PL 92-203, 85 Stat. 688; 43 USC 1601). The Statement of Work, Wage Determination for the Service Contract Act Compliance, and Clauses/Provisions are incorporated into the Solicitation. In accordance with FAR 36.602-1, interested contractors shall submit in their Package a signed SF-1449 and the following upon which the selection criteria of award will be based in descending order as to the Best Value to the Government. 1) Specialized Experience/Technical Competence(is most important) 2) Past Performance is most important (provide references and work performed) 3) Capacity to accomplish work in the required time. 4) Knowledge of the locality of the project, and 5) Price. All offerors shall submit proposals consisting of a separate (1) technical approach volume and (2) price volume. The volumes shall be as follows: Volume One: Technical Proposal and Volume Two: Price Proposal. Each volume shall be separate and complete in itself so that evaluation of one may be accomplished independently of each other. The technical proposal shall not contain price information, however, resource information such as data concerning labor hours and categories, materials, subcontracts, etc. must be contained in the technical proposal that the offeror's understanding of the detail and complexity of the requirements may be evaluated. EVALUATION OF OFFERS/CONTRACT AWARD: The Bureau of Indian Affairs will award a contract to the responsible contractor whose offer conforming to this announcement will be most advantageous to the government, price and other factors considered. The following evaluation factors will be used to evaluate technical offers: SECTION M - EVALUATION FACTORS FOR AWARD: (1) Technical Capability: Understanding of the Scope of Work and Soundness of Approach (25 Points) (2) Technical Capability: Completeness and Thoroughness in Compliance with All Requirements Documents Elements and with Other Solicitation Requirements. (25 Points) (3) Technical Capability: Management and Key Personnel (25 Points) (4)Technical Capability: Commitment To Meeting the Requirements of the Solicitation According to Schedule (25 Points) (5) Technical Capability: Capability, Responsibility, and Past Performance in Similar Programs. (25 Points). Technical and past performance, when combined, are significantly more important than price. Price shall be considered when the offers are judged as offering technically equivalent capabilities or if a price is so high as to diminish the value of an otherwise superior quotation. TO QUALIFY FOR THIS AWARD, THE CONTRACTOR MUST PROVIDE A PRICE PROPOSAL FOR THE BASE YEAR (MAY 1, 2012 THROUGH DECEMBER 31, 2012) PLUS ALL FOUR OPTION PERIODS.
