- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the solicitation. The NAICS Code is 334515 with Small Business size standard of 500 employees. The request for quote (RFQ) reference number is H94003-12-T-1205. The government's intended sole source for this proprietary software is Agilent Technologies, Inc., 9780 S. Meridian Blvd. Englewood, CO 80112-5910. All responsible sources may submit a capability statement quotation which shall be considered by the agency. The requirement is for continued software updates, maintenance and support for Agilent IC-CAP and ADS Software Tools at Defense Microelectronics Activity (DMEA), 4234 54th St, McClellan, CA 95652. The objective of this procurement is to purchase one year of software updates, maintenance and support for Agilent's IC-CAP and ADS software tools. The vendor shall provide software updates, maintenance and support IAW performance specification (PS) 12-2A9 for all software tools identified in PS 12-2A9, Appendix A. All vendor software products currently in use at DMEA will be evaluated annually by DMEA to determine if additional software tool products are required or if existing products are no longer required. At award, the vendor shall provide DMEA a list of all vendor products that will be End of Life (EOL) during the upcoming bid year. If a product is determined to be EOL, the vendor will provide a recommendation to DMEA for evaluation. The vendor shall provide telephone and electronic support services to DMEA design engineers and system administrators identified in PS 12-2A9, Appendix B. The vendor shall deliver all new products and updates to the DMEA system administrator according to current vendor delivery procedures. FOB point is Destination. Copies of PS 12-2A9 and its Appendices A and B are available from the contract specialist identified below. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-55. The following FAR clauses apply: 52.212-1, 52.212-2 Evaluation - Commercial Items, Instructions to Offerors - Commercial; 52.212-3, Offeror Representations and Certifications-Commercial Items; 52.212-4 Contract Terms and Conditions-Commercial Items and 52.212-5, Contract Terms and Conditions required to Implement Statutes or Executive Orders-Commercial Items. DFARS clause 252.212-7001, Contract Terms and Conditions required to Implement Statutes or Executive Orders Applicable to Defense Acquisition of Commercial Items, 252.232-7010 Levies on Contract Payment.
