Description
The U.S. Army Contracting Command-New Jersey, on behalf of PM SoldierWeapons, intends to solicit, negotiate, and award a sole source modification to Kongsberg Defence & Aerospace (KDA) under the authority of 10 U.S.C. 2304(c) (1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. FAR 6.302-1(b)(2), The existence of limited rights in data, patent rights, copyrights, or secret processes; the control of basic raw material; or similar circumstances, make the supplies and services available from only one source. FAR 6.302-1(a) (2) (ii) (B), Unacceptable delays in fulfilling the agencys requirement regarding VIM/TIM lens covers for the Common Remotely Operated Weapon Station (CROWS) provided by Kongsberg Defence and Aerospace. The anticipated effort will be a Firm Fixed Priced (FFP) Modification to Contract # W15QKN-07-D-0018. The acquisition of CROWS VIM/TIM lens covers from sources other than Kongsberg Defense and Aerospace will not meet the schedule requirements. It is likely that award to any other source would result in unacceptable delays in meeting PM SWs requirements as a result of the unacceptable lead times from contract award to the services rendered. A prototype, qualification, and production development time required for any new potential source to develop a solution does not meet the Government schedule requirements. KDA has a production-ready product that has been qualified by the Government. Failure to meet this timeline will result in a break in the supply of CROWS VIM and TIM lens covers, which provide protection from damage from debris or other contaminants that, may damage the VIM or TIM lens. Damage to the VIM or TIM requires replacing the entire damaged module for a spare VIM or TIM. This replacement process incurs extensive maintenance cost and can result in unacceptable weapon station downtime, as well as detrimental impacts to mission readiness and War fighters safety. KDA is the only source able to meet the Government's CROWS VIM and TIM lens covers requirements without disclosing KDA's proprietary design. Please note this notice DOES NOT constitute a Request for Proposal (RFP). A determination by the Government not to compete this proposed contract action based upon the responses to this notice is solely within the discretion of the Government. The anticipated award date for this action is the 12th of March 2012.
