- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. U.S. Army Space and Missile Defense Command (SMDC) intends to issue a contract to GeoEye Analytics Inc., McLean, VA through solicitation no. W91260-12-T-0001, pursuant to the authority of FAR Parts 12 and 13.106-1(b) Sole Source Acquisitions. GeoEye Analytics Inc., will be providing Perpetual EarthWhere license (10U), GeoEye Analytics Inc P/N EW-4X-0010-P, QTY: 1 EA which includes one (1) year maintenance, GeoPDF Module Software maintenance (10U) renewal for 11 (eleven) months, and LizardTech Module Software maintenance (10U) renewal for 11 (eleven) months for SMDC 1st Space Brigade, Colorado Springs, CO. The period of performance for the GeoPDF and LizardTech Module Software maintenance renewals is 04 Feb 2012 through 31 Dec 2012. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulations document (FAR) subpart 12.6, as supplemented with additional information included in this notice. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-55 dated 03 Jan 2012. The Government intends to solicit and negotiate with only source under the authority of FAR 13.106-1(b). There is only one responsible source and no other services will satisfy agency requirements. GeoEye Analytics Inc. is the manufacturer of the EarthWhere software product and is the sole source provider of the EarthWhere related modules, maintenance, licenses, and support services. GeoEye Analytics Inc. has no authorized dealers, distributors, or re-sellers. The required EarthWhere software modules are available exclusively from GeoEye Analytics Inc., who holds exclusive rights to the software due to its proprietary license agreement. A justification for Other than Full and Open Competition has been prepared and approved by the Contracting Officer in support of this acquisition. The provision at FAR 52.212-1, Instructions to Offerors, applies to this acquisition to the extent consistent with a sole source acquisition. Offeror shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer. The clause at FAR 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition. The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition. The clause at DFARS 252.232-7003 Electronic Submission of Payment Requests and Receiving Reports (MAR 2008), applies to this acquisition. The attached Army Electronic Invoicing Instructions (FEB 2006) are incorporated into and made a part of this solicitation and will be incorporated into and made a part of the resultant contract. Offeror must submit a quote or proposal via email to: cynthia.gama@smdc-cs.army.mil by 4:00 PM (Mountain Standard Time) on 31 Jan 2012 to be considered by the Government. IMPORTANT!!
