- Justification for Sole Source This is a "Special Notice" to process a "Sole Source" modification of an existing contract to increase the estimated usage on the base and option years for exclusive rights television programming. Reference Federal Business Opportunity (FBO) solicitation/ posting number "HQ002811D0003", for commercial items (television programming) posted in accordance with Office of Federal Procurement Policy Memorandum dated 17 APR 2006, as supplemented with additional information included in this notice. This government requirement, if solicited, would be advertised as an "Unrestricted" procurement with provisions and clauses in effect through Federal Acquisition Circular 2005-55 dated 03 JAN 2012. Contractors must be registered with the Central Contractor Registration (CCR) database (http://www.ccr.gov/) at time award is issued and throughout performance. The government intends to award a "Sole Source" modification to contract HQ0028-11-D-0003 to extend the estimated dollar thresholds (usage) of the base and four one-year options (Performance Period: April 18, 2011 through March 31, 2016) to contractor "Buena Vista Non-Theatrical, Inc (BVNT)" for Television Programming for which the contractor holds exclusive rights. The contractor shall provide broadcast rights to television programming it acquires from ABC, ABC Family, and the Disney Channel to AFN to reproduce and distribute, provide live feeds or recorded copies of authorized programs and provide access to affiliate information data networks and/or websites. AFN will distribute the programming by encrypted, digitally compressed satellite transmission system (currently Cisco's PowerVu Plus (MPEG-4)) and/or by mail to authorized AFN television outlets outside the contiguous United States for their non-commercial distribution/ presentation via television broadcast frequencies, encrypted, digitally compressed satellite transmission, limited closed-circuit distribution systems and, where approved, video on demand service. This "Special Notice" is not a request for competitive offers/quotes/proposals. A determination by the Government to compete this special notice will be based upon responses to this notice at the sole discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Responses must be submitted within the close of the publication of this notice TO BE RECEIVED NO LATER THAN 2:00 PM PACIFIC TIME FEBRUARY 3, 2012 IN ORDER TO BE CONSIDERED.
