Description
The U.S. Army Contracting Command-New Jersey, on behalf of PM Soldier Weapons, intends to solicit, negotiate, and award a sole source modification to Kongsberg Defence & Aerospace (KDA) under the authority of 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1(a)(2)(ii)(B) & FAR 6.302-1(a)(2)(iii)(B) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirement regarding Spare Parts and Depot Support for the Common Remotely Operated Weapon Station (CROWS) provided by Kongsberg Defence and Aerospace. The anticipated effort will be a Firm Fixed Priced (FFP) Modification to Contract # W15QKN-07-D-0018 that will increase the ceiling by $85M. The increased demand for deliveries of Spare Parts in 4QFY12 and Depot Support needed to begin 3QFY12 to sustain the higher number of deployed systems can only be met by KDA. The acquisition of CROWS Spare Parts and Depot Support from sources other than Kongsberg Defense and Aerospace will not meet the schedule requirements. It is likely that award to any other source would result in unacceptable delays in meeting PM SWs requirements as a result of the unacceptable lead times from contract award to the services rendered. The potential new source would have to manufacture CROWS spares that would function both reliably and safely and have a Government qualified depot to perform these system repairs. Failure to meet this timeline will result in a break in the supply of spare parts, an increased risk of not being able to sustain deployed CROWS systems, and consequently, detrimental impacts to mission readiness and Warfighters safety. KDA is the only source able to meet the Government's CROWS spares and depot support requirements without disclosing KDA's proprietary design. Please note this notice DOES NOT constitute a Request for Proposal (RFP). A determination by the Government not to compete this proposed contract action based upon the responses to this notice is solely within the discretion of the Government. The anticipated award date for this action is the 30th of May 2012.
