Description
This Sources Sought Notice is for planning purposes only and shall not be construed as a solicitation or as an obligation on the part of the National Highway Traffic Safety Administration (NHTSA). The purpose of this Notice is to identify potential sources that may be interested in and capable of performing the work described herein. The NHTSA welcomes Corporate Capability Statements from all individuals and organizations. The NHTSA does not intend to award a contract on the basis of responses nor otherwise pay for the preparation of any information submitted or NHTSA's use of such information. Acknowledgement of receipt of responses will not be made, nor will respondents be notified of NHTSA's evaluation of the information received. As a result of this Notice, the NHTSA may issue a Request for Proposals (RFP). However, should such a requirement fail to materialize, no basis for claims against the NHTSA shall arise as a result of a response to this Notice. Providing prosecutorial viewpoints and a legal perspective on traffic safety laws, with an emphasis on impaired driving and coordinating our efforts with the Traffic Safety Resource Prosecutors, known as the Prosecutors Traffic Law Coordination Center (PTLCC) As noted in our Report to Congress on the FY 2003 Expenditure of Funds for Judges and Prosecutors, NHTSA emphasizes the importance of additional outreach to the prosecutorial and judicial components of the criminal justice system. Impaired driving cases are one of the most difficult types of cases to prosecute. Frequently the less experienced prosecutor is assigned to impaired driving cases. NHTSA has in the past worked with the National District Attorneys Association (NDAA) to provide resources to assist prosecutors in the effective prosecution of impaired driving cases. On November 21-22, 2002, the NHTSA and the National Criminal Justice Association sponsored a Criminal Justice Summit to identify gaps, problems and challenges in the criminal justice system in the handling of impaired drivers and then to assess solutions and strategies for increasing effectiveness in the enforcement, prosecution and adjudication phases of impaired driving cases. The prosecutors identified the following recommendations: Urged prosecutors to take a leading role at the local level to reduce DUI incidents. Recommended that prosecutors help inform traffic safety agencies and raise community awareness on DUI laws, rights and penalties, i.e., to distinguish the difference between probable cause and reasonable doubt. Recommended that clearinghouses for training, videotapes and publications be maintained at the national and state level. Called for a state level "traffic resource prosecutor" position in every state. Suggested that prosecutors help share best practices/what works from neighboring jurisdictions. Urged for more experienced prosecutors to be involved in DUI cases. Encouraged loan forgiveness programs to attract and retain qualified prosecutors. The Traffic Injury Research Foundation (TIRF) conducted a study to identify the need for improvements in the DWI system by identifying priority problems and recommending practical solutions. Prosecutors identified ten key problems that impeded the effective prosecution of hard core drinking drivers. The problems include: evidentiary issues, test refusal, motions and continuances, incomplete records, inadequate or inconsistent penalties, failure to appear, legislative complexities, expert witnesses, plea agreements, and prosecutor training. From 2004 to 2009, NHTSA, NDAA and National Association of Prosecutor Coordinators (NAPC) brought together the Traffic Safety Resource Prosecutors from 40 states to discuss: NHTSA's priorities, developing relationships with other partners, DWI/Drug Courts, performance measures, and the importance of working with the State Highway Safety Offices. Breakout sessions have been held on TSRP issues, including performance measures, and information on the Standardized Field Sobriety Testing and the Drug Evaluation and Classification Programs for prosecutors. Discussions were also held on a strategic vision for TSRPs and their interaction in the traffic safety community. These sessions have also be fruitful for the TSRPs as they have been able to mentor the less-experienced TSRPs on what they have accomplished and the tools that they have developed. To assist in outreach to prosecutors and be responsible for developing, revising and pilot testing training programs to prosecutors; maintaining the briefs of impaired driving cases; providing technical assistance to law enforcement officers and prosecutors on impaired driving cases; and making presentations at National meetings. Specifically, objectives of this Contract will be: •1. Provide technical assistance to prosecutors and law enforcement officers; •2. Publish a quarterly newsletter; •3. Promote and develop national training for prosecutors and law enforcement officers; •4. Write and/or collaborate on model laws for NHTSA on an as-needed basis; •5. Work in conjunction with the National Association of Prosecutor Coordinators (NAPC) on Traffic Safety Resource Prosecutor (TSRP) training and Prosecutor of the Year efforts; and p erform legal literature reviews on an as-needed basis. Format of Corporate Capabilities Statement: Any interested organizations should submit the Corporate Capability Statement which demonstrates the firm's ability and interest in no more than 10 pages to perform the key requirements described above. All proprietary information should be marked as such. All respondents are asked to indicate the type and size of their business organization, e.g., Large business, Small Business, Small Disadvantaged Business, Women-Owned-Business, 8(A), Historically Black College or University/Minority Institution (HBCU/MI), educational institution, profit/non-profit organization, in their response. Interested offerors shall respond to this Sources Sought Notice no later than 15 calendar days from date of posting. E-mail is the preferred method when receiving responses to this Notice.
