Description
THIS IS A NOTICE OF AWARD FOR A SOLE SOURCE CONTRACT. The National Park Service has awarded a sole source contract to the State of Michigan, Michigan Public Safety Communication System (MPSCS), Lansing, Michigan. The State of Michigan is a governement agency that will provide MicroWave antenna space on the State of Michigan, MPSCS tower #9006 for Isle Royale National Park, Houghton, MI 49931 as authorized by FAR 6.302-1 and 41 U.S.C. 235(C) (1) to the State of Michigan. Award Number: P12PX65841 Award Amount: $5,700.00 Award Date: 10/01/2011 Vendor: MANAGEMENT AND BUDGET, MICHIGAN DEPARTMENT OF 320 S WALNUT ST LANSING, MI 48933-2014 US JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION(NON-COMPETITIVE PROCUREMENT) (Technical/Requirements Personnel shall answer each of the following) 1. Identification of the agency and the contracting activity, and specific identification of the document as a "Justification for other than full and open competition." DOI, NPS Isle Royale National Park The park is leasing MicroWave antenna space on the State of Michigan, MPSCS tower #9006. This 475 foot tower is located in Keweenaw County, Calumet, MI. This tower is the only tower located within range of the park that is located 50 miles from the mainland on Lake Superior that has the required height to permit the parks micro wave phone and communication system to function on the island. The micro wave antennas must be located at 423' and 413' on the tower. 2. Nature and/or description of the action being approved. Lease of tower space and secure room for installation of associated radio/phone equipment. 3. A description of the supplies or services required to meet the agency's needs (including the estimated value). Antenna space on 475' tower to install two micro wave dishes one at 423' and one at 413'. Micro wave dishes will provide phone and computer communication from Isle Royale to the mainland. 10' cu. Ft of secure building space is included to house communication equipment. 4. An identification of the statutory authority permitting other than full and open competition. Only one source exits however this represents a safety issue and we must have award. Posted after the fact; due to urgent and compelling requirements to keep communication lines open between the mainland and the island. 5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. The State of Michigan has the only tower in the Keweenaw Peninsula that meets the height requirements to make the micro wave system functional. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. FAR 5.202(a) (2) 7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The cost of the lease is based on pre determined rates as established by the State of Michigan MPSCS. The lease will cost the NPS $11,400.00 for the first year of the five year lease. Years two - five will cost $5,700.00 annually. The NPS cannot secure land and construct and maintain a tower of this size when compared to the cost of lease. 8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted. State of Michigan Tower #006 is the only tower available that meets the height requirements in both Houghton and Keweenaw Counties and site located to access the island located 50 miles on Lake Superior from the antenna site. 9. Any other facts supporting the use of other than full and open competition, such as: (i) Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. (ii) When 6.302-1 is cited for follow-on acquisitions as described in 6.302-1(a) (2) (ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived. (iii) When 6.302-2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government.This system provides safe and secure communication between the park mainland and island. It is detrimental to the public safety without it. 10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. No other sources have implied or expressed interest in this procurement due to the requirements of the tower and costs.11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. No other tower meeting the requirements to have a functional micro wave phone system is available to lease. 12. Contracting officer certification that the justification is accurate and complete to the best of the contracting officer's knowledge and belief. Concurred by: S.
