Description
Introduction: Pursuant to FAR Subpart 13.106-1(b)(1), the U.S. Army RDECOM Contracting Center, Natick Contracting Division, on behalf of the Natick Soldier System Center (NSSC), intends to award a firm fixed price purchase order for Maintenance and Services of Dimension Icon AFM on a sole source basis to: Bruker Corporation, 3400 East Britannia Drive, Suite 150, Tuscon AZ 85706 THIS IS NOT A REQUEST FOR PROPOSALS. No solicitation document is available. 1) FAR Statutory Authority cited: 13.106-1(b)(1) - only one responsible source and no other supplies or services will satisfy agency requirements. 2) Nature and description of the supplies or update required to meet the agency's needs: Approval is requested to award a sole source contract for Service/Maintenance for the Atomic Force Microscope (AFM) System ICON SYS. The service will provide maintenance of the AFM System ICON SYS via one annual preventive maintenance check and corrective repair of the instrument when required. If not granted, any problems that may arise with the instrument will be costly to repair, and will take longer to get the repair done. 3) A demonstration that the proposed contractor is the only source available to provide these services or goods (i.e. unique qualifications, proprietary rights, etc.): The AFM was manufactured by Veeco Instruments, Inc., which was acquired by Bruker Corporation. This is a very specialized/complicated piece of equipment and should be serviced by the manufacturer; hence, only Veeco/Bruker technicians are qualified to maintain/repair it. Additionally, this highly complex piece of equipment may require original manufacturer's parts. Should repairs or routine maintenance be performed by other than qualified Veeco/Bruker technicians, the extended warranty would be null and void. Furthermore, there are concerns over coverage following the initial warranty period which is about to expire. 4) A description of the market research that was conducted and the results, or a statement of the reason a market research was not conducted: Extensive market research was conducted at the time of the purchase of the equipment (October 2010). The AFM was purchased from a distributor via a competitive solicitation. The Veeco system was the only one that met the Government's needs. 5) Any other facts supporting the use of other than full and open competition: The quote submitted by Bruker Corporation appears to be fair and reasonable based upon comparison with maintenance contracts for similar laboratory equipment. 6) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: Continuous monitoring of the industrial base will be performed to take advantage of the competitive forces in the marketplace. 7) Technical/Requirements Certification I certify that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
