- NOT REQUIRED FAR 5.202a2 NOTICE OF INTENT TO AWARD 12TC0198. North American Industry Classification System Code 334310 Standard Industrial Code 3651 The 802d Contracting Squadron intends to issue a sole source firm fixed priced purchase order to 3dMD LLC., 100 Galleria Pkwy Ste 1070, Atlanta, GA. 30339 for the purchase of 3dMD system comprehensive support. 3dMD is the only vendor that can provide the 3dMD system comprehensive support to the Government based on interoperability and capability concerns. The service must be purchased from the manufacturer. This requirement is to include the following: Item Quantity Unit Part Number 3dMDface System Annual Maintenance and Support 1 Years n/a 3dMDcranial/face System Annual Maintenance 1 Years n/a 3dMDvultus Software Annual Maintenance and Support 1 Years n/a JUSTIFICATION: SALIENT CHARACTERISTICS 1. Support and Maintenance offered must be compatible with 3dMD's system software and hardware. The statutory authority permitting other-than-full-and-open competition is 41 U.S.C., 253(c) (1): FAR 6.302-1 and FAR 13.106-1(b) (1). Only one responsible source and no other services will satisfy agency requirements. Interested persons may identify their interest and capability to respond to the requirement. This notice is not a request for competitive proposals. A determination by the Government not to compete this proposed contract will be based on responses to this notice and is solely within the discretion of the Government. IAW 5.207-16 (ii) all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency within three (3) days of this notice. Information received will be considered solely for informational purposes. This procurement is not set-aside for small business and the intent of this procurement is to award based on Sole Source requirement. The proposed contract action is for commercial items which the Government intends to solicit and negotiate with only one source under authority of FAR subpart 6.302-1 (ii). The anticipated award date is 24 October 2011. This solicitation document and incorporated provisions and clauses in effect through Federal Acquisition Circular 2005-53 Effective 4 Aug 2011 and DFARS Change Notice 20111004, which apply to this procurement.
