- Justification for Other than Full and Open Competition Identifications;Agency: National Park Service, Yellowstone National Park Sole Source Contractor: Xanterra Parks and Resorts Inc. Description of the action: Provide fuel for National Park Service vehicles and boats in the Bridge Bay area. Description of supplies and services: The contractor will provide unleaded and diesel fuel for FY1 2 The period to be covered is October 21, 2011 to September 30, 2012 Statutory authority: 41 USC. 253(c) (2); FAR part 6.302-2-1, Only one responsible source and no other supplies or services will satisfy the agency requirements. Reason for authority cited: Back in 1992-93, the government fueling station at Bridge Bay Marina was found to be leaking into the ground. At this same time, Xanterra (then TW Services) was in the process of upgrading their existing fueling station tanks to double wall technology, which was mandated by law. In the interest of preserving the lake water, the decision was made by NPS management to remove and clean up the government tank site and not replace them. In the past, credit card purchases were made to cover the cost of fuel. Due to rising fuel costs in recent years, this is no longer a desired method of payment Efforts to obtain competition: special notice posted on Fed Biz Ops Determination that costs will be fair & reasonable: Comparison of prices for other commercial services and government estimate. Description of the market research conducted: No other provider is located in the marina and none will be allowed by the government Other facts supporting other than full & open competition: When the NPS fuel tanks were removed from the Bridge Bay Marina site, the NPS found it to be in the best interest of the government to purchase fuel from the concessionaire, the only fuel available in the area. As Xanterra is the main concessionaire for Yellowstone National Park, there was already an existing contract to provide fuel for the public at the marina. This action also put all responsibility and liability on Xanterra for maintaining the fueling station. This was seen as the best solution both environmentally and financially for Yellowstone Park. No other viable solution is available, as fueling from a delivery truck presents many safety issues. Adding another fueling station to this area, temporary or otherwise is not an option NPS management is not considering at this time. lnterested Sources: Xanterra Actions to remove barriers to competition in the future for similar acquisitions: No actions are being considered at this time.
