- The Air Force intends to establish a Basic Ordering Agreement (BOA), FA8620-12-G-4000, with Raytheon Company of McKinney, Texas for development and support of the Airborne Cueing and Exploitation System Hyperspectral (ACES HY) sensor. This BOA and subsequent delivery orders placed against it constitute follow-on efforts to the competitively-awarded Defense Microelectronics Agency contract H94003-04-D-0006. As for the BOA, individual delivery orders for future efforts will be synopsized IAW FAR 5.201. A Sources Sought Notice for the ACES HY requirement was posted in FedBizOpps on 06 June 2011. All responses to the Sources Sought were carefully considered before the decision was made to solicit and negotiate with only one source in accordance with FAR 6.302-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." Market Research determined that award of this highly-specialized follow-on contract to any source other than Raytheon would likely result in substantial duplication of costs to the Government and unacceptable delays in fulfilling Air Force requirements. Moreover, the existence of limited rights in data leaves Raytheon as the only responsible source. However, IAW FAR 5.207(c)(16)(ii), all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency if received within 15 calendar days of the posting of this notice. No solicitation is available. Firms interested in subcontracting opportunities should contact Raytheon directly. Award of this BOA is anticipated for early January 2012. The period of performance for the BOA will be 3 years with 2 option years. Whether this requirement will be competed remains within the discretion of the Air Force. The Government is not responsible for any costs incurred should interested parties respond to this notice.
