Description
LIMITED SOURCE JUSTIFICATION RQ Number: 21000-11-6097 J&A Number: 2011-0076 This acquisition is conducted under the authority of Section 201 of the Federal Property and Administrative Services Act of 1949 (40 U.S.C.501) Multiple Award Schedule Program FAR 8.401 and is justified by the following facts and rationale required under FAR 8.405-6 (b)(1). 1. Identification of the agency and the contracting activity, and specific identification of the document as a "Limited Sources Justification." This is a limited sources justification for the U.S. Securities and Exchange Commission, Office of Secretary, SEC Library, 100 F Street, N.E., Station Place, Washington, D.C. 20549. The acquisition will be conducted under the authority of the Multiple Award Schedule Program, pursuant to FAR 8.401. The Contracting Activity responsible for this action is U.S. Securities and Exchange Commission, Office of Acquisitions, 6432 General Green Way, Alexandria, VA 22312-2416. 2. Nature and Description of Action Being Approved: The U.S. Securities and Exchange Commission (SEC) has a requirement on a limited source basis for legal, accounting, and business publications to CCH, Inc., Chicago, Illinois. This is a contract renewal. 3. Description of the supplies or services required to meet the needs of the SEC and the estimated value: The requirement is for legal, accounting, and business publications and their updates published by CCH, Inc. The publisher shall ship print publications to SEC staff per SEC instructions. The estimated contract value for this requirement is $80,000.00, for a period of performance of September 1, 2011 through August 31, 2012. FY11 funds will be used for this requirement. 4. Identification of the Justification and Rationale. This acquisition is being conducted under the authority of the Multiple Award Schedule Program in accordance with FAR 8.405-6(b)(1): (b)(1). Only one source is capable of responding due to the unique or specialized nature of the work. 5. Determination by the ordering activity Contracting Officer that the anticipated order represents the best value consistent with 8.404(d). The Contracting Officer has determined that issuing the proposed Task Order to CCH represents the best value and will result in the lowest overall cost alternative, considering price and administrative costs, to meet the Government's needs. This order will be placed in accordance with FAR 8.404 - Use of Federal Supply Schedules. General Services Administration has already negotiated fair and reasonable pricing. Prior to issuance of the task order, the ordering activity may consider other factors in determining that the total price is reasonable. 6. Description of a market survey conducted and results or statement of the reasons a market survey was not conducted. A formal market survey was not conducted because CCH is the only Contractor that can provide the required publications. The required publications are published only by CCH and CCH holds the copyright for their content. These publications contain unique research and commentary, created by CCH's editors and authors. The uniqueness of the information, combined with the copyright protection, makes CCH the only known source. Commission staff requires these publications to perform their official duties. 7. Other Supporting Facts: None. 8. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. The Commission's information requirements are ongoing and future acquisitions of similar services will be advertised.
