DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 16, G.V. (Sonny) Montgomery VA Medical, Jackson, MS. Purchase Requisition VA 2237 - 586-12-1-033-0028 2.Nature and/or Description of the Action Being Processed: The G. V. (Sonny) Montgomery VA Medical Center has requirements for the preventive maintenance and emergency repairs of the sterilizers and cart washers to be awarded under a new firm fixed price contract. 3.Description of Supplies/Services Required to Meet the Agency's Needs: GETINGE 0 USA, INC. will provide the service to GETINGE equipment located in the SPD department under their Preventive Maintenance Plan, which will be conducted by the skilled GETINGE Service Representative in order to continue optimum performance and reliability. The period of performance is anticipated to be from 10/1/2011 to 9/30/2014, including options. The estimated total value for this service in not expected to exceed $228,109.00. 4.Statutory Authority Permitting Other than Full and Open Competition: ( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): GETINGE USA, Inc. offers highly specialized preventive maintenance and emergency repairs to the sterilizers and cart washers utilized by the SPD department to maintain ultimate use of equipment and instrument during surgery. In accordance with VA Handbook 7176, august 16, 2002, Part 801, specifically states that the operational functions of sterilizers must adhere strictly in accordance with the manufacturer instructions. GETINGE USA, Inc. will only guarantee work performed by a GETINGE certified technician. GETINGE USA, Inc. is the equipment manufacturer and the sole source supplier of factory authorized original equipment (OEM) replacement parts and accessories for their equipment. These parts are tested for performance, longevity, and cost effectiveness. They, also, meet OEM operational requirements and provide the best performance life in application of use. GETINGE USA, Inc. offered a Limited Parts Warranty, which is the best in the business. GETINGE USA, Inc. has performed this service for th past several years without incident. Without this service, the G.V. (Sonny) Montgomery VA Medical Center will experience a substantial duplication of cost that could not be expected to be recovered through competiton and will experience unacceptable delays in the fulfillment of this requirement. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The mandatory sources were surveryed and no other vendor stated that they were able to perform the reqired service. GETINGE USA,Inc requires technicians to be GETINGE certified to warrant the work performed. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: There has been an average of approximately 9% increase in pricing over the last several years, which has not exceeded the Government's Independent Estimate (IGE). If the repairs are not covered under the GETINGE USA, Inc service plan, it is expected that the repairs would more than double in price. Based on the comparative analysis of the historical data and the technical professional judgement, the price is considereded to fair and reasonable. 8.Description of the Market Research Conducted and the Results. or a Statement of the Reasons Market Research Was Not Conducted: The market research was conducted in accordance with FAR Part 10, utilizing CCR and VetBiz. These sources revealed vendors under the same NAICs Code, but with not expertise in the highly specialized service of providing precision maintenance and equipment repairs to the front load steam sterilizers and cartwashers.
