- The U.S. Department of State (DOS), Office of Acquisition Management intends to issue a Sole Source Award to Cisco Systems 8865 Stanford Blvd, Suite 201; Columbia, MD 20145, for product verification tool (1) CS-BRAND-01 Statement of Work: To perform serial number and MAC address verification on Cisco products to ensure they are genuine Cisco products. Work with DS/OBO/ENM and other State organizations to gather appropriate information to then go back to Cisco Brand Protection to determine if the products identified are genuine or not and work with the appropriately designated individuals at State to resolve/rectify any issues found. Work will be performed by Cisco personnel only as they are the only ones with access to this data (S/N - MAC Address database) and can perform testing for genuine products of Cisco products. QTY-33; estimated cost $49,500.00. NOTE: JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION - 1. The Office of Acquisition Management is conducting this acquisition for serial number verification against MAC addressees on Cisco products to ensure they are genuine on behalf of IRM/OPS/ITI/TSS. 2. Nature and/or description of the action being approved New Contract. The company is to perform Serial Number and MAC address verification on Cisco products to ensure they are genuine Cisco products. Work with DS/OBO/ENM and other State organizations to gather appropriate information to then go back to Cisco Brand Protection to determine if the products identified are genuine or not and work with the appropriately designated individuals at State to resolve/rectify any issues found. 3. A description of the supplies or services required to meet the Department's needs. The company is to perform Serial Number and MAC address verification on Cisco products to ensure they are genuine Cisco products. The estimated cost is $24,250 per year, for a base and one option year ($49,500 total). 4. An identification of the statutory authority permitting other than full and open competition. 41 USC 253(g) and FAR 13.106-(b), Only one responsible source. 5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. Work will be performed by Cisco personnel as they are the only ones with access to the CISCO internal Cisco Serial Number (S/N) to MAC Address database. Therefore, Cisco is the only source that can perform this unique testing procedure to establish the validity of Cisco products. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. A Synopsis will be issued in accordance with FAR Subpart 5.2. 7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The cost to obtain this information from reports generated by Cisco is much less than the cost that would be incurred to create and maintain a similar State Department database. However, this is moot because the data is not publically available and therefore Cisco is the only source. 8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. Cisco personnel are the only ones with access to the CISCO internal Cisco Serial Number (S/N) to MAC Address database. Therefore, Cisco is the only source that can perform this unique testing procedure to establish the validity of genuine Cisco products. 9. Any other facts supporting the use of other than full and open competition. None. 10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition. None. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Include a statement that this J&A for other than full and open competition will be published on FedBizOpps in accordance with FAR Section 6.305 within 14 days of award (or within 30 days if the J&A is for unusual and compelling urgency.) None. Cisco is the only source that can perform this unique testing procedure. Acquisitions conducted under simplified acquisition procedures are exempt from the requirements in FAR Part 6. Nonetheless, this Justification will be publicized on FedBizOpps with the Combined Synopsis/Solicitation, in accordance with FAR 5.102(a)(6).
