- Army Contracting Command National Capital Region Justification for Sole Source Purchase Purchase Request #: 0010062257 1. Contracting Activity: The Army Contracting Command-National Capital Region (ACC-NCR) is the procuring activity for this action. 2. Description of the Supply or Service Purchased: Renewal of five Sea Sentinel user licenses with distance table and port disbursements. This is a proprietary, commercial and secure data source for obtaining current sea port operations and infrastructure, capabilities and security data. 3. Dollar Amount: The estimated total purchase price is $11,925.00. Operation and Maintenance Army (OMA) funding in this amount will be utilized. 4. Authority Cited: FAR 13.106-1(b) Soliciting from a single source: (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization). 5. Reason for Authority Cited: Services can only be provided from the original source as this is a follow-on requirement for the continued provision of highly specialized services. IHS Fairplay has an exclusive licensing agreement that is proprietary. 6. Efforts to Increase Competition: This office will routinely check the required sources prescribed by FAR Part 6 for additional vendors that can provide the required IT products and services. Any future requirements will be solicited and evaluated based on their own merit and, to the maximum extent practicable, be procured using full and open competition procedures. 7. Market Research: Market research was attempted on 15 September 2011 through the internet to determine if there were any other viable sources available. This search did not identify any vendors who could provide this software except IHS Fairplay. When calling IHS Fairplay at 2 different locations (Miami, Florida and Englewood, Colorado) the same person Ashley Morgan answered the telephone. I was informed there is only 1 account for each customer no matter which location I would call. This requirement will be posted on FedBizops for 5 calendar dates after all approvals are received from the KO and Small Business. 8. Procurement History: Purchase Order W91WAW-10-P-0166 for this requirement was issued on 15 July 2010 in the amount of $9,487.00. Further, IHS Fairplay sent us 3 invoices from 3 other procurements from their company to commercial market vendors that show the US. Army shall receive the same price as the commercial market. These 3 invoices shall be placed under market research. 9. The POC for this action is, e-mail address: 10. Fair and Reasonable Price/Cost Determination: I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable based upon FAR 13.106-3(a)(2)(i) Market Research and FAR 13.106-3(a)(2)(ii) Comparison of the proposed prices found reasonable on previous purchases. 11. Contracting Officer's Approval: Based on the foregoing, I approve the procurement described above on other than full and open competition basis pursuant to the authority of 10 U.S.C. 2304(c)(1) and FAR 6.302-1(a)(2) subject to availability of funds, and provided that the supplies and property herein described have otherwise been authorized for acquisition. /////////Signed///////// CAROL A.
