- Brand Name Justification Terms and Conditions Notice of Intent to Award Notice of Intent to Award a Sole Source Single. The Department of Education, Federal Student Aid (the Department), intends to solicit on a sole source basis under the authority of FAR 13.106-1(b)(2) to Phoenix Software International, Inc., 831 Parkview Drive N, El Segundo, CA 90245-4932. This procurement is being conducted under Simplified Acquisition Procedures (SAP) - only one responsible source and no other supplies or services will satisfy agency requirements. Phoenix Software is the sole developer and supplier for Falcon and (E)JES Software and is the only company that can provide the software maintenance needed. The Department intends to award to Phoenix Software International, Inc. for Falcon and (E)JES software maintenance.
