- Limited Sources Justification (63000-11-2377) This Announcement is amended to provide notification that the SEC has made the determination to award a FAR Part 8 Limited Sources procurement for this requirement. The Limited Sources Justification for this action is attached. When this notice was first published, the SEC intended to award an open market purchase order to Oracle America, Inc. for this support. A J&A was approved in accordance with FAR Part 6 and attached to the original notice. However, the SEC and Oracle were not able to reach agreement on the terms of a software agreement in a timely manner. Therefore, to ensure that there is no lapse in service, the SEC made a determination to award this requirement to a certified reseller of Oracle that provides this support on a GSA Schedule contract. The attached Limited Sources Justification replaces the FAR Part 6 J&A that was originally approved and posted. Orignial Notice: The U.S. Securities and Exchange Commission (SEC) intends to negotiate on an other than full and open competitive basis with Oracle America, Inc. for annual maintenance license renewal of SEC's Oracle Middleware Software Suite. Oracle Middleware software is the only product that has been identified as capable of satisfying the SEC's requirement. This software supports the SEC's critical applications. Therefore, if this software is not renewed, the SEC will not be able to acquire support for the Oracle application suite, which is used by critical applications such as HUB and TCR. Due to licensing, warranty, and compatibility issues, it is not possible for another source to meet the SEC's requirement. The statutory authority permitting other than full and open competition is 41 U.S.C. 253 (c) (1), implemented by FAR 6.302-1 - Only one responsible source and no other supplies or services will satisfy agency requirements. The Justification and Approval for this action is attached to this notification. The SEC intends to award a contract to Oracle on or about September 20, 2011. This notice is not a competitive request for proposals. A competitive solicitation will not be issued. However, the government will give consideration to interested parties that identify their interest and capability to respond to the requirement or submit proposals by the response date of this notice.
