- This procurement, supported by Justification for Other than Full and Open Competition, is being conducted under the authority of 41 United States Code (U.S.C.) 253(c)(5) as set forth in Federal Acquisition Regulation (FAR) 6.302-5. This acquisition is restricted to Indian firms under the buy Indian Act in accordance with the Health and Human Service Acquisition Regulation 370.504-(b). Under the authority of the Patient Protection and Affordable Care Act, P.L. 111-148, and the Indian Health Care Improvement Act Amendments of 2009 (IHCIA) the Secretary shall, through the IHS, enter into contracts with Indian tribes and Indian organizations for the provision of health care, educational, programs, and related services. The Indian Health Board of Nevada (IHBN) shall provide statewide Indian Health Service beneficiaries and tribal leader oriented training and education in the key provisions and impact of the Patient Protection and Affordable Care Act (ACA). Because of the large target population and numerous tribal governments and tribal leaders to be trained, the primary method to be used is a "train the trainer" approach. The organization listed is uniquely qualified to fulfill the requirement. As an Indian organization they are familiar with all of the tribal governments in their respective state and have worked closely with them for many years on health care issues. The IHBN is knowledgeable of the tribal governments and their health care needs. IHBN also has the cultural sensitivity necessary to approach and work closely with tribes on health care issues. Because of the specific location (State of Nevada) of the Tribes and target population to be served, and the oversight responsibilities of the state-wide Indian organization, the IHBN is the only logical and credible source to meet the objectives in the short time frame required. The IHBN previously has provided substantial information and training on the ACA to the tribes in the State of Nevada.
