Description
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of the agency and the Contracting Activity The U.S. Department of State, Office of Acquisition Management is processing this acquisition at the request of the Department of State, Bureau of International Organizational Affairs, Office of International Conferences (IO/C), APEC 2011 Planning Team. 2. Nature and/or Description of the Action Being Approved The United States will host the Asia-Pacific Economic Cooperation (APEC) meetings in 2011 consisting of five discrete groups of meetings between December 2010 and November 2011 in several different U.S. locations. APEC is the premier economic organization in the Asia-Pacific region and aims to bolster trans-Pacific cooperation. APEC is comprised of 20 other Member Economies besides the United States. APEC 2011 will culminate in a Leader's Meeting held in November 2011 in Honolulu, Hawaii. Following review of appropriate spaces, a decision was made to certain Presidential events at this venue for security and other considerations. In addition, during this timeframe, Leaders from the Trans-Pacific Partnership (TPP) negotiating countries will be invited to a special session on November 12, 2011. 3. Description of the Supplies or Services Required to Meet Agency's Needs The Hale Koa is needed to hold both the APEC Leaders Dinner and Cultural Reception. The Leaders Dinner requires a dinner setting for the 21 APEC Leaders and their spouses. The second part of the evening consists of a reception and cultural entertainment for invited APEC Economy delegates numbering around 600 people. In addition, the TPP special session would also utilize meeting space at the Hale Koa Hotel. The Hale Koa Hotel is the only facility in the Waikiki-area that is in close proximity to other APEC events and hotels and has the remaining space and capacity to host these events during the given timeframe. Several factors were used in determining that the Hale Koa was the appropriate location to host these events, such as the logistics of moving participants from their accommodations to the Hale Koa and the quality and size of the space needed to accommodate the entire day's events. This J&A is for the lease of the function space at the Hale Koa. 4. Identification of the Statutory Permitting Other than Full and Open Competition The proposed procurement is to be made under the statutory authority of 41 USC 253(c)(1), FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. 5. Demonstration that the Contractor's Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited. The Hale Koa Hotel is centrally located in the heart of Honolulu at the gateway to the Waikiki- area. APEC delegates will be utilizing accommodations in the Waikiki-area and shuttle service, security barriers and directional guidance for the meeting will be focused in this geographical area. The Hale Koa will offer a convenient venue for the APEC Leaders Dinner and Cultural Reception. Due to the great need for function space from 21 APEC Economies during Leaders Week, many appropriate venues and spaces had previously been reserved. The Hale Koa had enough remaining space to host the Leaders Dinner, Cultural Reception and TPP special session that needed to happen consecutively on the same day. The spaces were both appropriate and available for the desired event date and available both prior and after the event date to allow for sufficient build-up and break-down of equipment. Furthermore, the capacity of the function space met the event requirements, as did the security considerations. Other venues in the general vicinity were considered, but 1) did not have availability during the desired time frame, 2) did not fulfill security considerations for this event and 3) did not have the amount of appropriate space available to support the full schedule of the day's events. Therefore, the Hale Koa Hotel was uniquely qualified to meet the requirements that were previously described. The Hale Koa is available for the scheduled timeframe of APEC Leaders Week, November 8-13, 2011 and more specifically the Leaders Dinner and Cultural Reception on November 12, 2011. 6. Description of Efforts Made to Ensure that Offers Were Solicited from as many Potential Sources as Was Practicable. Different venues were surveyed for space and availability and the Hale Koa Hotel is the only facility that has the appropriate space, in a close proximity to other APEC events, necessary to house this event during the scheduled timeframe. A Fedbizopps notice will be published in accordance with FAR Part 5. 7. Determination of the Contracting Officer that the Anticipated Cost to the Government Will be Fair and Reasonable The Contracting Officer has determined that anticipated costs to the Government are fair and reasonable based on the commercially listed prices documented for the lease of the Hale Koa Hotel. 8. A Description of the Market Survey Conducted and the Results or a Statement of the Reasons A Market Survey was not Conducted Other venues in the general vicinity were considered, but 1) did not have availability during the desired time frame, 2) did not fulfill security considerations for this event and 3) did not have the amount of appropriate space available to support the full schedule of the day's events. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition See paragraphs 5, 7, and 8. 10. A Listing of Sources if Any, that Expressed, in Writing an Interest in the Acquisition No sources expressed in writing an interest in this acquisition. 11. A Statement of the Actions, If Any, The Agency May Take to Remove or overcome Any Barriers to Competition Before Any Subsequent Acquisition for the Supplies or Services Required The removal of barriers is not applicable for subsequent acquisition of services required in Hawaii for the APEC meetings.
