DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 08, Caribbean Healthcare System VA Medical Center RQ 672-11-4-291-0177 2.Nature and/or Description of the Action Being Processed: This request is for other than full and open competition for the procurement of Mammography Reporting system software. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Procurement of Mammography Reporting System (MRS) for VACHS San Juan Woman Veteran Program 4.Statutory Authority Permitting Other than Full and Open Competition: FAR 6.302-1 (b) (2) the existence of limited rights in data, patent rights, copyrights, or secret processes. (x) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The MRS system is the only system that can interface with HL7. Without the HL7 link software is unable to communicate with our Vista and PAC's system. Mammography Reporting System is the proprietary owner of the MRS software and is the only vendor who can supply software updates. It is in the best interest of economy and efficiency to procure this software FAR 16.505 (b) (2) (B) Exceptions to the fair opportunity process. Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: This is a Women's Health Initiative for VISN 8, software have to be the same to be compatible through VISN 8 only one company can provide software and support needed. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Estimated cost to the government is $50,250.00 price is fair and reasonable and compares to other medical centers acquisition for same product. This is a Women's Health Initiative for VISN 8. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Researched GSA and found that this is not sold on GSA then researched on the internet and found that this software is trade mark from MRS they are the sole producer, seller and licensing of this software 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: This is a Women's Health Initiative for VISN 8. MRS software provide Paperless workflow using MRS Quest Touch is the greenest, fastest, most accurate and most cost effective way to record and track patient and procedure information. The flexible paperless system, combined with reliable MRS tracking and reporting system, makes the entire patient information collection process paperless, saving the facility valuable time and money.
