Description
Justification and Approval for Other Than Full and Open Competition Justification 1. Contracting Activity: Department of Veterans Affairs, Material Management and Acquisition Department. 10 N. Green Street Baltimore Md., 21201. a. Requesting Activity: Department of Veteran Affairs (Biomedical Engineering), 10 North Greene Street, Baltimore Md., 21201 2. Description of Action: Approval is requested to award a new service contract for support of the Sonatom Definition Flash CT Scanner. Approval is requested to use Fund Control Point (641) to finance this requirement. 3. Description of Supplies/Services: Siemens Medical Solutions has a highly qualified team of Field Service Engineers who specialize in Maintenance and repair of the Siemens Sonatom Flash CT Scanner. This system will be out of warranty on 07/22/2011; this request is for partial year coverage at $40,000 with option years at approximately $206,000/yr. 4. Authority Cited: Identify the statutory authority permitting other than full and open competition, followed by the FAR citation and FAR citation title by checking one of the following: ( X ) 6.302-1 -- only one responsible source and no other supplies or service will satisfy the agency requirements. ( ) 6.302-2 -- unusual and compelling urgency. ( )6.302-3 -- industrial mobilization; engineering, developmental, or research capability, or expert services. ( ) 6.302-4 -- international agreement. ( ) 6.302-5 -- authorized or required by statue ( ) 6.302-6 -- national security. ( ) 6.302-7 -- public interest. ( ) 13.501(a)(1)(ii) authority of the test program for commercial items, Section 4202 of the Clinger-Cohen Act of 1996; or the authority of the Services Acquisition Reform Act of 2003 (41 U.S.C. 428a). 5. Reason for Authority Cited: Radiology Service has a full range of imaging equipment that requires manufacturer specific expertise to maintain. The Sonatom Flash is a high tech, high cost system manufactured by Siemens Medical Solutions and is proprietary in nature. There are various levels of software access required to diagnose error codes, perform calibrations, and perform scheduled maintenance on this device that a "Third Party Vendor" would not possess. Obtaining service from another vendor would result in Siemens being relieved of any accountability for failure of software and hardware that has not been validated by Siemens Medical Solutions. Further, obtaining service from Third Party Company could potentially increase equipment down time and create patient backlog. Subsequently, an additional cost will be incurred by the facility for sending patients to other locations to have procedures performed. 6. Efforts to Obtain Competition: Describe efforts to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. Also describe the extent of effective competition anticipated for this acquisition. 7. Actions to Increase Competition: There may be instances when it is not possible to compete the current acquisition. Include a statement of the actions taken, or to be taken to increase competition. 8. Market Research: Describe the extent and the results of the market research (FAR Part 10) conducted to identify all qualified sources. Research must have been meaningful and conducted within the previous 12 months. 9. Interested Sources: To date, no other sources have written to express and interest. 10. Other Facts: Discuss any other facts supporting the use of other than full and open competition, such as the following: a. Procurement history. Reasonable efforts to retrieve the following items from computer records, contract files, competition advocate files or other sources are expected: (1) Contract numbers and dates of the last several awards, if applicable. (2) Competitive status of these actions. (3) Authority previously used for less than full and open competition. (4) If a justification was prepared to support the procurement made before this one, a summary of the contents of paragraph 7 of the justification for that procurement and an explanation of the results. (5) If any prior award was accomplished by full and open competition, a detailed explanation of the changed circumstances. (6) An explanation of any unusual patterns, which may be revealed by the history, e.g., several consecutive, urgent buys. (7) If a justification was prepared to support the procurement made before this one, briefly describe the circumstances justifying the buy and whether there have been any significant changes. (8) When 6.302-1 is cited for follow-on acquisitions, an estimate of the cost of the Government that would be duplicated and how the estimate was derived. (b) Acquisition data availability. Explain why technical data packages, specifications, engineering descriptions, statements of work or purchase descriptions suitable for full and open competition have not been developed or are not available. Describe actions taken or planned to remedy this situation. (c) When 6.302-2, Unusual and compelling urgency is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government. (d) Subcontracting competition. In single source situations, address efforts to be taken by the Government to assure that the prime contractor obtains as much competition as possible in its subcontracting. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
