Description
Introduction: Pursuant to FAR Subpart 13.106-1(b)(1), the U.S. Army RDECOM Contracting Center, Natick Contracting Division, on behalf of the Joint Program Executive Office for Joint Product Management Office for Biosurveillance (Provisional) (JPM BSV) intends to award a firm fixed price purchase order on a sole source basis to: Idaho Technology, Inc., Salt Lake City, UT, 84108. THIS IS NOT A REQUEST FOR PROPOSALS. NO SOLICITATION DOCUMENT IS AVAILABLE. INQUIRIES WILL BE USED FOR FUTURE ACQUISITIONS ONLY. 1. Nature and description of the supplies or services required to meet the agency's needs: The Joint Product Management Office for Biosurveillance (Provisional) (JPM BSV) has the requirement to refurbish 40 Government-owned JBAIDS analyzers and accompanying CF-30 Panasonic laptops. Refurbishment activities include cleaning of the JBAIDS backpacks, repair of the instruments as needed, replacement of JBAIDS backpack consumable parts, recalibration of the JBAIDS instrument detectors, and loading the latest JBAIDS software configuration on the CF-30 laptops. Additionally, the latest updated JBAIDS system manual is placed in the backpack along with a CDROM of the latest software release. JPM BSV used these analyzers for in vitro diagnostic kit clinical trials as required by the U.S. Food and Drug Administration (FDA) and training. 2. A demonstration that the proposed contractor is the only source available to provide these services or goods (i.e. unique qualifications, proprietary rights, etc.): JBAIDS is a modified commercial off-the-shelf (COTS) acquisition by the Department of Defense. The DoD did not purchase design rights to the JBAIDS hardware, software or consumables when the program started in September 2003. Since the start of the JBAIDS program over 340 JBAIDS systems have been delivered worldwide to all four US military Services at a dollar value of greater than $76M. Only the JBAIDS prime contractor, Idaho Technology Inc. (ITI) can recalibrate the JBAIDS analyzer detector hardware using contractor proprietary chemistry assays. Also, only ITI has access to repair parts for the system instruments with accompanying electronic schematics. No drawings have been purchased for the JBAIDS analyzer to date that could potentially allow a third party to perform repairs on the JBAIDS instruments; the Government did not purchase instrument parts breakdowns/parts, or software data rights. During the competitive source selection, the Government agreed to limited data rights on all the information now necessary to refurbish fielded equipment. 3. A description of the market research that was conducted and the results, or a statement of the reason a market research was not conducted: JPM BSV reviewed the technical data required to refurbish the JBAIDS analyzers and concluded only the prime contractor, ITI, can complete the effort successfully. 4. Any other facts supporting the use of other than full and open competition: As noted in above, JPM BSV does not have access to the JBAIDS hardware design and manufacturing information. This information (engineering electronic schematics, parts breakdown lists, system software source code, etc.) is required to refurbish the 40 Government-owned JBAIDS analyzers. 5. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: No actions have been taken by the Government program office to purchase data rights on the COTS JBAIDS equipment. The refurbishment costs are less than $2.0K per system. 6.
