Description
Justification for Other Than Full and Open Competition. (a) Each justification shall contain sufficient facts and rationale to justify the use of the specific authority cited. As a minimum, each justification shall include the following information: (1) Identification of the agency and the contracting activity, and specific identification of the document as a "Justification for other than full and open competition." USCG Command, Control, and Communications Engineering Center, C3CEN in support of CG Cutter Midgett via ESU Seattle Vessel Support (2) Nature and/or description of the action being approved. Emergency Procurement of Diving Services for Cutter Midgett (3) A description of the supplies or services required to meet the agency's needs. The USCG Cutter Midgett(WHEC378) requires the Emergency Services of Underwater Divers in support of the replacement of the DeepWater Transducer located under the Hull of the Vessel. In reference to a CAT-3 CASREP. The Vessel cannot safely navigate waterways without this critical piece of gear. The Underwater Divers will be required to install the Hull Blank-Off Plate thus allowing for the Transducer to be replaced with water entering the Transducer dept/ section, upon completion of the Transducer replacement, the Underwater Divers will remove Hull Blank-Off Plate. Estimated Not-To-Exceed Value: $35,000.00 (4) An identification of the statutory authority permitting other than full and open competition. 6.302-2 Unusual and Compelling Urgency. Emergency replacement of the DeepWater Transducer (5) A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. The Emergency Diving Services are required to support the CAT-3 CASREP for the Cutter Midgett, the Contractor Ballard Diving & Salvage, was contacted by ESU Seattle Vessel Support and asked if they would be able to provide the Emergency Diving Services on the Cutter Midgett in the time frame of AS SOON AS POSSIBLE. The Contractor stated they would be able to provide the Diving Services as soon as given CG/Gov authorization to do so. (6) A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. Requirement shall not be posted on FED-BIZ-OPS IAW FAR 5.202(a)(2) This JOTFOC will be posted within 30 days of award as required by: FAR 6.305(b) (7) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. As compared to hourly rates for Diving Services, the proposed amount is Fair and Reasonable. (8) A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted. Market research was conducted to assist in determination of fair and reasonable pricing. (9) Any other facts supporting the use of other than full and open competition, such as: (iii) When 6.302-2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government. This DeepWater Transducer allows the CG Vessel to Navigate safely in waterways and ports, without a fully operational DeepWater Transducer the CG Vessel may run aground thus rendering the Vessel inoperable and causing harm to Hull of Vessel, this damage would be very costly to the USCG/Government. Furthermore this damage would cause the Vessel to be inoperable and thus not allowing this CG Cutter to meet critical operational commitments. ******* (10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. None at this time (11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. None at this time. (12) Contracting officer certification that the justification is accurate and complete to the best of the contracting officer's knowledge and belief. (b) Each justification shall include evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government's minimum needs or schedule requirements or other rationale for other than full and open competition) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel.
